Por supuesto que, ante tales proyecciones, los políticos de turno han parado las orejotas y creen que tiene una nueva gallina de los huevos de oro para sacarles lo que no hay en impuestos. En sus apuntes sobre el Impuesto Selectivo al Consumo para apuestas deportivas y el juego online en Perú, el doctor Nicolas Samohod Rivarola, experto abogado en la industria del juego, dice que, la sumatoria de los impuestos al juego online, “podrían terminar llevando el impacto
económico sobre el contribuyente a cuotas cercanas al nefasto 20% que contempló la ley N°27153 de 1999, ya declarado inconstitucional por confiscatorio según la
importante y reconocida
sentencia del Tribunal Constitucional del año 2002:” Es decir, en Perú se proponen volver a la locura que tanto daño le hicieron los sesudos políticos de entonces al país, en los albores del despegue de la industria del juego. Pero no solo en Perú se cuecen estas inteligentes habas, porque Colombia también tiene su contrapartida de borricos, con algo similar para las llamadas, “apuestas localizadas”. Ante esto, el abogado Juan Camilo Turbay, experto en Juegos de Suerte y Azar, comenta sobre la falta de sapiencia, criterio, elemental juicio aritmético de funcionarios del Gobierno colombiano. ollowing a great trip to Las Vegas where we participated in the latest G2E, we have travelled to our beloved Lima, Peru, where the online gambling business keeps on growing with the entry of some global online players. It is considered by some experts to be a market that is expected to grow by 104% in the next three years, going from US$210 million to US$430 million in GGR.
Of course, in the face of such projections, some opportunist politicians have pricked up their ears believing that they have a new golden goose that lays golden eggs and are trying to extract taxes any which way from the new gambling sector. Commenting on this in his notes on proposed Selective Consumption Tax for sports betting and online gambling in Peru, Dr.
Nicolas Samohod Rivarola, an expert lawyer in the gaming industry, says that an additional tax imposition on online gambling, “could end up bringing the economic impact on the taxpayer to rates close to the disastrous 20% contemplated by Law No. 27153 of 1999, which has already been
declared unconstitutional as confiscatory taxation, according to the important judgment of Peru’s Constitutional Court in 2002:”
In other words, in Peru Politicians are intent to return to the madness that caused so much damage to the nation at that time, when the new gambling industry was just taking off. However, it is not only in Peru that such clever ploys are engendered, because Colombia also has its counterpart of donkeys, with something similar for the casino sector of “localized bets”.
