General de la Republica (CGR), dijo sobre el accionar de la Conajzar que “el hecho es penoso”, y dejado de ocultar su molestia por la situación, añadió, “que igual saldrá un dictamen del órgano contralor, pese a que ya se haya declarado al ganador”. Por su parte, el contralor general Enrique García, ya había asegurado que, si la Conajzar persistía en seguir con la detestada caricatura de licitación para la otorgación del monopolio de las apuestas deportivas en Paraguay, “iba a ser un nuevo atropello a la institucionalidad”. La CGR, previamente a la apertura de sobres, había solicitado la suspensión del proceso licitatorio para hacer una auditoría y emitir la recomendación, que iba a ser de carácter vinculante. Sin embargo, la Conajzar ignoró la solicitud y siguió adelante con el concurso. El órgano contralor tomó esta decisión luego de recibir denuncias de tres empresas afectadas al llamado. El gerente del JCP, Arnaldo Argüello, dijo que seguirán “peleando hasta lo último” para revertir la decisión de Conajzar. El JCP había quedado como único rival de Daruma Sam en el proceso, pero fue descalificado por -supuestamente- no cumplir con los requisitos en la licitación.
Dos empresas denunciarán ilegal proceso de concesión El JCP se suma a la firma YEM S.A. en su reclamo a través de la vía legal por la polémica licitación. YEM había sido descartada anteriormente y denunció que “el proceso estaba hecho a medida de Daruma Sam”, por lo que, tras agotar las instancias administrativas, adelantó a través de su representante legal que pedirán que se revierta el proceso ante la Justicia. Daruma SAM se quedará con un negocio que mueve 2,5 millones de
dólares mensualmente una vez que el Poder Ejecutivo ponga la firma y de por concluida la adjudicación. Considerando que el contrato sería por cinco años, se trata de un negocio de 150 millones de dólares, por lo que la industria paraguaya está atenta a lo que pueda suceder con el proceso. En noviembre, el diario paraguayo, ABC reportó: “El referido proceso de
licitación sobre la explotación de apuestas deportivas, desobedeciendo un dictamen de la Contraloría General, que pidió “la inmediata suspensión del proceso”. Todo apunta a que Daruma Sam SA podría quedarse con el multimillonario negocio para los próximos cinco años. Se mencionan padrinazgos del ministro Juan Carlos López Moreira, de Javier y Justo Zacarías Irún (este último consejero de Conajzar)”. En Paraguay, la ley orgánica de la Contraloría habla de la obligatoriedad del cumplimiento de las recomendaciones, dictámenes y conclusiones emanadas de este organismo. El diario ABC reporta que, al respecto, “el Sub Contralor General, Camilo D. Benítez Aldana, calificó, ante nuestra consulta, de temeraria la decisión del titular de la Conajzar, Javier Balbuena, quien pasó por alto todas las recomendaciones y los pedidos emanados desde la Contraloría y si bien admiten que la CGR no tiene fuerza coercitiva para hacer que se cumplan sus disposiciones, no descartan la posibilidad de denunciar penalmente al titular de la Conajzar por no cumplir la ley”.

Two companies denounce illegal concession process JCP joins YEM S.A., a tender candidate that has begun judicial process against Conajzar through the local courts on the controversial bidding terms. YEM had been disqualified by the regulators, and has reported that “the process was made to measure for the benefit of Daruma Sam”. Following exhausting administrative claims at Conajzar, the YEM legal representative has said that that they will ask the Courts to reverse the Conajzar sports betting tender process. Conajzar’s decision to award the sports betting monopoly
in Paraguay to Daruma SAM means that once the Executive signed the tender award in their favour, they will own a business with a minimum US$2.5 million monthly revenue. Considering that the tender awards a 5-year contract, Conajzar has gifted Daruma SAM a US$150 million business. Last November, leading Paraguayan daily, ABC reported: “The sports betting tender process, disobeyed an order from the Comptroller General’s Office calling for “the immediate suspension of the tender process”. All indications are that Daruma Sam SA could end up with the multimillion-dollar business for the next five years. The following are listed amongst the godfathers, Minister Juan Carlos López Moreira, Javier and Justo Zacarias Irun (this last person a consultant at Conajzar). In Paraguay, the Contraloria General de la Republica’s
organic law grants mandatory compliance of recommendations, orders and conclusions that are issued by this organism. ABC has reported that, in this regard, “The Deputy Comptroller General, Camilo D. Benítez Aldana, gave the opinion to the questions we asked, that Conajzar chief, Javier Balbuena, had made reckless decisions by overlooking all the recommendations and orders issued from the Comptroller’s Office. Although admittedly the Comptroller General has no coercive power to enforce orders issued from this office, neither do they rule out the possibility of taking the Conajzar chief to the Criminal Courts for failing to comply with the law.”
