PoolCorp Refutes Charges Of Anti-Competitive Behaviour
Pool distribution giant, PoolCorp is to robustly defend claims of anti-competitive behaviour in a landmark US law case that could have repercussions for the pool and spa industries around the world. The action has been fi led by specialist lawyers acting on behalf of a group, made up of swimming pool dealers and end-users, who have accused the distributor of breaking the law that prohibits monopolies. PoolCorp has been named in the legal action, along with three of the biggest names in pool and spa, Hayward Pool Products, Pentair Aquatic Systems and Zodiac Pool Systems. All are accused of violating the Sherman Antitrust Act, which prohibits activities that restrain trade or commerce. The latest chapter in a long-running David
vs Goliath battle looks set to be played out in the American courts. The latest legal moves follow a Federal Trade Commission enquiry that claimed PoolCorp pressurised manufacturers into exclusive agreements. PoolCorp did not agree but settled the case. With more than 3,200 employees and 300 plus locations worldwide, PoolCorp is world’s largest wholesale distributor of swimming pool supplies, equipment and related leisure products with an estimated 80,000 wholesale customers around the world and an offering of more than 160,000 national brand and private label products. Lawyers representing PoolCorp have now asked for an early dismissal saying PoolCorp had acted within the law and has no case to answer.

emblazoned with the message: ‘I’m Going’ are designed to encourage attendance to the event that is run by the industry itself and has a history dating back some 17 years.
Over £1 million has been raised and re-invested by SPATEX that offers information on all aspects of water related
subjects and works with expert independent bodies such as The Institute of Swimming Pool Engineers who produce education workshops throughout the three-day event. This year, for the fi rst time, The Pool

pwtag.org) who will be staffi ng a stand to promote both its new Code of Practice and the International Swimming and Spa Pool Conference to be held in Rome in April, 2013.

GIBRALTAR ROCKS UK-based pool, spa and wellness specialist, Cheshire Wellness has begun work on its latest international project. The company is providing fi ve swimming pools and eight spas for a major development in Gibraltar.
ESSEX BOOST
Residents of Braintree in Essex look set to benefi t from a £1 million investment into council-owned sport and leisure facilities thanks to the appointment of Fusion Lifestyle. Fusion Lifestyle, a registered charity specialising in providing high quality community sport and active leisure services, was appointed by Braintree District Council to manage and operate all fi ve of its leisure centres and sports facilities from last month.
SPLASH FOR CASH Nearly 2,000 swimmers at 57 venues run by DC Leisure participated in Swimathon 2012 raising £175,431 between them. Proceeds from this year’s £2.3m fundraiser will be shared by the Swimathon Foundation, Marie Curie Cancer Care and Sport Relief.
E-COLI CLOSURE Traces of E. coli have been found at the Bretton Water Park in Peterborough after children became ill due to an outbreak of norovirus.
The facility has been closed since July while investigations continue.
WOBURN UPDATE Center Parcs has been updating local residents about its new Warren Wood complex near Woburn in Bedfordshire that will have 625 forest lodges, a 75-bedroom hotel, a swimming pool and a lake.
The £250m centre, due to open in 2014, is the company’s fi fth UK resort and will create about 1,500 jobs.
