L
aWMakEr Au Kam San claims the government is
getting ready to pay out MOP2 billion in compensa-
tion to a contractor who was forced to place height
restrictions on a building under construction at the Calçada
do Gaio.
Au says he has evidence of the move and accuses the ad-
ministration of lacking transparency.
In a document he sent to officials, Au reveals information
on the amount of the compensation details of ongoing negotia-
tions between the firm and the government passed to him by an
anonymous source.
“The initial settlement has been reached and the gov- attribute the damages payable to the builder, instead of doing it
ernment will reimburse the builder to the tune of MOP2 “behind closed doors”.
billion. It’s truly shocking,’’ claims the legislator in his The Land, Public Works and Transport Bureau (DS-
letter. SOPT) denied that the developer would receive the amount
Au also says that the builder did not stop work when, last claimed by Au.
April, Chief Executive Dispatch 83/2008 was published “set-
ting the maximum height quotas allowed for building construc-
tion in the areas surrounding the Guia Lighthouse”. Construc-
tion went on night and day and the building quickly reached its
height limit.
Despite residents in the area reporting this situation to the
Lands, Public Works and Transportation Services Department,
the authorities did nothing for a long period.
Au claims the public always had doubts that the construc-
tion company would want compensation for the height limita-
tions imposed on the building because construction on it was
never interrupted.
“On May 30th 2008, I presented a written communication
on this compensation question in which I asked if the height
added to the building by the contractor after the dispatch was
announced would be taken into account when negotiating the
reimbursement,’’ says Au.
“I also questioned if the government was willing to negoti-
ate the damages in a judicial forum so that the whole process
could be transparent and there wouldn’t be any doubt on the
eventual ‘preferential interests’ attributed to that builder in par-
ticular,’’ he added.
The lawmakers claims the subsidies given by the govern-
ment to the population under the Wealth Partaking Scheme
amount to the same as this company will get.
“With this kind of situation, it’s no wonder that the gap be-
tween the wealthy and the poor in Macau has been widening,’’
says the legislator.
Au questions why the public wasn’t informed about the
negotiation process that led to the compensation, and calls on
the government to release the figures and the methods used to
calculate them.
He also asks why officials didn’t create a judicial forum to
