inheritance law and the implications of your requirements. Your Will can then be drafted and sent to you for review before the original document is properly executed.
If you own freehold or flying freehold property in Jersey then it is recommended that you have two Wills, one Will to deal with that property (a Will of Jersey Real Estate) and the other Will to deal with your own assets such as bank accounts and investments (a Will of Personal Estate). There are several reasons for this. The Will dealing with your Real Estate is registered in The Public Registry by the people who inherit the property upon your death and the Will of Personal Estate is submitted to Probate at the Judicial Greffe’s office upon your death. In addition, you may not wish one set of beneficiaries to see who inherits the other assets! By separating the Wills this is possible. Lastly, the rules governing
the execution of a Will of Real Estate are quite specific – it has to be read aloud in the presence of an Advocate, Solicitor, Notary Public or Members of the States of Jersey – in order to be valid.
It is recommended that legal advice is taken when you want to make a Will. I have seen numerous cases where the deceased attempted to make a homemade Will only for this to have disastrous consequences upon their death – for instance, one lady glued on a piece of paper to her handwritten Will with some wishes on it but the wishes were not clear and were incomplete and she did not leave directions for the distribution of the ‘residue’ of her estate which meant that she died ‘partially intestate’ anyway! (In other words, that part of her estate that she did not deal with in her Will would have to be dealt with as if she had not made a Will and which would
be determined by the rules under the provisions of the Wills and Successions (Jersey) Law 1993). For the sake of a reasonable fee for making a Will now a lot of long term problems, and expense, can be avoided in the future.
