Te existing regulatory and reasonable fees structure is progressively being eroded by capped and standardised fees, which may suppress the ability of an organisation to deliver the service in an ethical, cost-effective and appropriate manner. Such restrictions could force companies down the


route of outsourcing work to self-employed bailiffs, rather than their own trained and accountable staff. He sees no fundamental incompatibility


between the Traffic Management Act of 2004 and the proposals from the MoJ, but he does draw a distinction between, for example, council tax arrears and penalty charge notices. ‘We are only too aware that there are many cases of


genuine hardship involved in the collection of council tax arrears. However, the non-payment of parking fines is one


of the most misrepresented areas of public complaint. Tere are very few cases where either the original

Functional parking management ‘We have an astonishing 31 million vehicles on our roads – that’s more than one vehicle for every household in the country. Properly controlled parking is an absolute necessity for urban and suburban communities to function, and unfortunately this cannot be done without a system of fines and collection,’ Naylor observes. He would like to see far more comparative analysis of recovery rates, fees charged and methods used between bailiff companies available for local authorities. Tis includes transparency of information; recovery procedures strictly in accordance with the regulations; the ability to identify ‘can’t pays’ and ‘gone aways’; and the use of fully employed bailiffs with local knowledge. Te best way forward is by working with bailiff


companies that are members of a recognised body employing their own, well-trained staff, and by encouraging everyone involved in the process to share information about rights and responsibilities.
