El pliego establece que el plazo máximo de concesión será de 10 años, con la posibilidad de una prórroga adicional de hasta dos años, a discreción del Gobierno provincial. No se ha fijado un número máximo de licencias a otorgar, lo que abre la puerta a un esquema competitivo basado en criterios técnicos, operativos y económicos.
En términos económicos, el canon a abonar por los licenciatarios no podrá ser inferior al 15% del resultado bruto mensual, calculado sobre el total de apuestas realizadas menos los premios efectivamente pagados. Las empresas extranjeras interesadas no podrán participar de manera individual, debiendo hacerlo exclusivamente a través de Uniones Transitorias o estructuras asociativas con empresas locales online con otros procesos regulatorios provinciales en Argentina.
De acuerdo con la Ley Nº 14.235, estarán habilitadas las apuestas sobre cualquier competencia deportiva existente o futura, siempre que cuente con la autorización de la autoridad de aplicación. Entre las disciplinas contempladas se incluyen, entre otras, fútbol, básquet, tenis, rugby, vóley, automovilismo, boxeo, artes marciales, hockey, golf y ciclismo. No obstante, el marco legal es explícito en cuanto a las exclusiones: no estarán permitidas las apuestas online sobre juegos de casino tradicionales, tales
como ruleta, tragamonedas, póker tradicional, bingo, ni tampoco sobre juegos de lotería, que quedan fuera del régimen de licencias de apuestas deportivas online.

No maximum number of licences to be granted has been set, opening the door to a competitive scheme based on technical, operational and economic criteria.
In economic terms, the fee to be paid by licensees may not be less than 15% of monthly Gross Gaming Revenue (GGR), calculated on the total bets made minus the client wining or prizes paid out. Interested foreign companies will not be able to participate individually and must do so exclusively through partnerships or associative structures with local companies in line with other provincial regulatory processes in Argentina.
In accordance with Law No. 14,235, betting on any existing or future sports competition will be allowed, if it has the authorization of the enforcement authority. Sport disciplines include football, basketball, tennis, rugby, volleyball, motor racing, boxing, martial arts, hockey, golf and cycling, plus any other approved thereafter. The legal framework is explicit in terms of exclusions: online betting on traditional
casino games, such as roulette, slots, traditional poker, bingo, or lottery games, which are outside the online sports betting licensing regime, will not be allowed.

Comisión del Senado avanza con prohibición de publicidad de apuestas
La Comisión de Ciencia y Tecnología (CCT) del Senado brasileño aprobó un proyecto de ley que establece la prohibición total de la publicidad y promoción de apuestas deportivas de cuotas fijas y juegos online, conocidas en Brasil como “Bets”. La iniciativa fue aprobada el miércoles 4 de febrero y modifica la Ley de Apuestas Deportivas, extendiendo la prohibición a todas las acciones de comunicación comercial y también a la promoción de apuestas vinculadas a resultados electorales.
El texto aprobado prohíbe la publicidad, el patrocinio y la promoción de apuestas deportivas y juegos online en todo el territorio nacional. La restricción alcanza a las apuestas de cuota fija, aquellas en las que el monto potencial de ganancia se define al momento de realizar la apuesta. La prohibición incluye anuncios en radio, televisión, diarios, revistas y redes sociales, patrocinios de
eventos y clubes deportivos, publicidad indirecta —como inserción de productos en programas de televisión o avisos durante transmisiones deportivas— y la preinstalación de aplicaciones de apuestas en teléfonos móviles, tabletas o televisores inteligentes.
Las sanciones por incumplimiento contemplan advertencias, multas de entre R$5.000 y R$10 millones, suspensión y revocación de la autorización para operar apuestas de cuotas fijas, pudiendo aplicarse de forma acumulativa.

Senate Committee moves forward with ban on betting ads
The Science and Technology Commission (CCT) of the Brazilian Senate approved a bill setting out total prohibition of advertising and promotion of fixed-odds sports betting and online games, known in Brazil as “Bets.” The initiative was approved on Wednesday, February 4 and modifies the Sports Betting Law, extending the prohibition to all commercial communications actions and also to the promotion of bets linked to electoral results.
The approved text prohibits advertising, sponsorship and promotion of sports betting and online games throughout the national territory. The restriction applies to fixed-odds bets, in which the potential amount of profit is determined at the time the bets are placed.
The ban includes ads on radio, television, newspapers, magazines and social networks, sponsorships of sports events and clubs, indirect
advertising – such as inserting products into television programs or ads during sports broadcasts – and the pre-installation of betting apps on mobile phones, tablets or smart TVs.
The penalties for non-compliance include warnings, fines of between R$5,000 and R$10 million (US$1-2 million), suspension and revocation of the authorization to operate fixed odds betting in Brazil, and these may be applied cumulatively.
