Diputados aprueba de urgencia votación para ley de casinos


La Cámara de Diputados aprobó por régimen de urgencia el proyecto de ley para legalizar los juegos de casino y bingo en Brasil (PL 442/91), además de la popular lotería ilegal Jogo bo bicho. Bajo la tutela del presidente de la cámara, Arthur Lira, la solicitud fue aprobada por 293 votos favorables, 138 en contra y 11 abstenciones. Ahora el texto pasará a ser debatido por el pleno, teniendo en


cuanta de que el PL puede pasar al voto en cualquier momento, sin tener que pasar por comisiones. La noticia representa el mayor avance en Brasil hacia la legalización de los juegos de azar y la instalación de casinos en el país. Según el presidente de la Cámara, los diputados deben, ahora, iniciar el debate sobre los méritos del proyecto de ley ahora, teniendo en cuanta que la votación sobre el texto será para febrero 2022. Según el reglamento de la Cámara, dependiendo de la aprobación de la solicitud urgente, el proyecto de ley no necesitará pasar por las comisiones de la Cámara, aunque este ya ha sido aprobado por un comité especial creado para este fin. El nuevo texto del PL 442/91 propone la creación del SINAJ –


Sistema Nacional de Juego, integrado por un organismo regulador y supervisor federal, entidades operadoras, agentes de apuestas, entidades de turba y empresas de autoría contable y operativa. Entre varios criterios, se definió que no se puede realizar ninguna operación en dinero físico, con el fin de rastrear todas las transacciones financieras del operador y también del jugador. Según la propuesta, se debe instituir una tasa de inspección de juegos y apuestas (TAFIJA), con valores definidos de acuerdo con la modalidad a explotarse, que se debe pagarse trimestralmente, así como la aplicación del impuesto a la renta sobre el total bruto ingresos por el Juego (Gross Gaming Revenue - GGR), así como un impuesto del 20% al apostante sobre el premio.


El documento también establece la Contribución de Intervención Cide-Jogos en el Ámbito Económico, del 25% sobre los juegos de azar comercializados online y del 20% sobre la comercialización de juegos de azar en establecimientos físicos, cuyos valores se repartirán entre la Unión Federal, los Estados y los Municipios. Una vez en el pleno, el texto puede recibir modificaciones en forma de enmiendas y luego ser remitido al Senado. El diputado Barcelar, dijo que la votación en Diputados fue una victoria del GT y corona de éxito el trabajo realizado en tan poco tiempo, añadiendo: “Nos reunimos con todas las dependencias gubernamentales que se encargan de la supervisión, regularización y otras entidades federativas. La revisión del PL 442/91 del GT fue muy exhaustiva y tuvo excelentes informes”, indicando finalmente, “a partir de ahora el proyecto se puede votar en el Pleno, cualquier momento”.

Brazil’s House of Representatives approved the bill to legalize casino and bingo games in Brazil (PL 442/91) as well as the popular illegal lottery Jogo do bicho, via an urgent parliamentary session. Debated under the tutelage of The Speaker of the Chamber, Arthur Lira, the application was approved by 293 votes in favour, 138 against and 11 abstentions. Now the text will be debated by the plenary, taking into account that the PL can go to the plenary vote at any time, without having to go through committees. The news represents the biggest step towards the legalization of gambling and the installation of casinos in Brazil. According to Lira, the representatives must now begin debating the merits of the bill, taking into account that the vote on the full text is set for February 2022. According to House rules procedure and depending on the approval of the urgent request, the bill will not need to go through the committee stage, although PL 442/91) has already been approved by a special committee created for this purpose. The new PL 442/91 text bill proposes the creation of Sistema Nacional do Jogo -SINAJ (National Gambling System), composed of a federal regulatory and supervisory body, operating entities, betting agents, horse racing and accounting auditing firms. On the matter of responsible gambling, the document proposes the creation of a “National Policy for the Protection of Gamblers and Bettors”, as well as the implementation of the National Registry of Gamblers and Bettors, with specific criteria to prevent money laundering. Among the money laundering criteria, the


bill states that no operation can be carried out using cash, in order to track all financial transactions by the operator and also the player. According to the proposal, a gaming and betting inspection fee (TAFIJA – Brazilian acronym) must be also instituted,


with amounts defined according to the modality to be exploited, which must be paid quarterly. Also set out in the bill is the application of income tax on gambling gross revenue (GGR), as well as a 20% tax winnings by the bettor. The document also establishes a gambling tax rate as Cide-Jogos Contribuição de Intervenção no Domínio Econômico (Contribution through Intervention in the Economic Field) of 25% for online gambling and of 20% for land-based gambling. The taxes will be distributed between the Federal Union, the States and the Municipalities. Once in plenary, the text can receive modifications in the form of amendments, and then must be forwarded to the Senate. Rep. Bacelar said that the vote in the House of Representatives was a victory for the GT and crowns the success of the work done in such a short time. He added: “We met with all the government agencies that are responsible for supervision, regularization and other federal entities. The work on PL 442/91 by the WG was very exhaustive and we’ve had excellent reports,” finally indicating, “from now on the bill can be voted on in the Plenary, at any time”.
