Fair Manager of the Martin County Fair. His background is in Television, former DJ. Professional Drummer. He will be completing the IAFE institute this Fall as well as his CFE. He is a member of the IAFE Sponsorship Committee. According to Jay, "I am coming up on my 30th


wedding anniversary with my lovely wife Barbara. We have 2 college graduates finding their way in the world. Proud to be recognized by my fellow peers and associates. Looking to make a difference in the fair industry."

A question sometimes has arisen in the past on


whether a fair association can loan money to its di- rectors and officers. We are of the opinion that a fair association should not loan money to its directors or officers.


A fair association is defined in the Florida Statutes

as an association not for profit incorporated under Chapter 616 for the purpose of conducting and oper- ating public fairs or expositions. Pursuant to Chapter 617 of the Florida Statutes, loans may not be made by a Florida not for profit corporation to its directors or officers.


In addition, a loan to a director, or officer, may run


afoul of IRS regulations, specifically, the private in- urement doctrine inasmuch as the assets of a tax ex- empt organization cannot inure to the private benefit of an individual connected with that organization.


Lastly, Florida Statute 616.07 makes clear that all


money and property of the fair association is public property which shall be administered by the fair asso- ciation as trustee, to be used exclusively for the legit- imate purpose of the association. Arguably, a loan of fair money to a director or officer does not serve a legitimate purpose of the fair association.
