102 PLANNING FOR LATER LIFE

no one is putting any pressure on you to make the powers in their favour. • If your attorney(s) need to look after your fi nancial affairs your solicitor will send them certifi ed copies of your property and fi nancial affairs form for their use. • Your attorney(s) will take or send a copy to your bank, building society, pension provider, or other fi nancial institution with whom you are affi liated. They will then be registered on your accounts and your attorneys will then be able to access and operate them on your behalf. • If your attorney(s) need to make health and welfare decisions for you, again, your solicitor will provide them with certifi ed copies of your health and welfare form to be registered with your GP or other health professionals involved in your care.

Doing it online

• You can get someone else to use the online service or fi ll in the paper forms for you, for example a family member, friend or solicitor. • You must register your LPA or your attorney won’t be able to make decisions for you. • You need to sign the forms before you send them off. They also need to be signed by the attorneys, witnesses, a certifi cate provider, who confi rms you’re making the LPA by choice and you understand what you’re doing. • Witnesses and certifi cate providers must be aged 18 or over. Attorneys can witness each other sign, but they can’t witness you sign or sign as the certifi cate provider.

Making your LPA couldn’t be easier

Making Lasting Powers of Attorney gives you the chance to appoint those you know and trust to make decisions that are in your best interests when you are at your most vulnerable. Without making LPAs, you may leave yourself and your family exposed without the required legal framework to allow others to help you, should you require assistance.

Claire Nash Solicitors are your local solicitors providing friendly and expert advice. Offi ce and home visits are available, including out of hours appointments if required.

Quote the INDEX Magazine, and receive a free Will check to ensure your will still refl ects your wishes and is up to date. • Call 01892 731082 or email claire@ clairenashsolicitors. co.uk

The power of LPAs You can draw up your own Lasting Powers of Attorney (LPA) however, it is a very powerful legal document that requires careful consideration. If you are unsure, there is any conflict within the family, or there are complex assets, you should consult a fully- qualified solicitor. For an added level of

reassurance you may wish to consult a solicitor who has additional qualifi cations such as Society for Trust and Estate Practitioners (STEP) and Solicitors for the Elderly (SFE). • For more information, call Gail Hall on 01732 770660 or email g.hall@warners.law

INHERITANCE TAX only applies to the super wealthy so why do I need to worry?

Statistics show that over 50% of the total annual receipts from inheritance tax is paid by estates within the South East. High property prices often mean that the value of your home alone can bring you within the inheritance tax net resulting in a 40% tax bill. Planning to reduce your inheritance tax liability isn’t

just for the super rich either and there are many simple ways in which you can mitigate this.
