PricewaterhouseCoopers estimates that

Kenya’s gambling market should be earning the Kenya Revenue Authority somewhere in the region of KES500m annually in VAT and withholding taxes. It is said many casinos pay the withholding tax on behalf of clients so their punters can leave with their winnings intact. AGOK has filed a suit against the

controversial withholding tax saying “clauses affecting taxation of winnings are contradictory and not clear on who should in fact pay the tax.”

LOTTERY Te Kenya Charity Sweepstake is the main

health standards after independence. l Lotto – Tickets cost KES50 and players pick six numbers between one and 36. Draws are held every Saturday afternoon. Top winnings are KES1m.

l Lucky3 – Tickets cost between KES20 and KES250 and players pick any three numbers between zero and nine. Draws held Monday to Saturday daily. Top prize (match all three numbers) to win 400x the stake.

choose between two and 10 numbers within the range of one to 60 with 12 numbers drawn daily. If players match 10 numbers they win KES500,000

l Scratch cards – Tere are nine different cards ranging from KES20 to KES200 for a card and they can be bought from kiosks and other outlets. Since its launch the Charity Sweepstake has

given away KES4.2bn in prizes and recently introduced mobile based games which were launched in 2015. Te company has more than 300 agents across Kenya and has donated KES742m to 4,600 charity projects since it began. Draw based games can be played via mobile phones via Mpresa and Airtel Money. In July this year a second national lottery was

launched called the Pambazuka National Lottery offering 6/49 game where players select six of 49 numbers via a single or combi ticket. Te draw is held on Wednesdays and Sundays and players can buy tickets via agents or via SMS or via SportPesa online. Tis lottery aims to donate revenue to

healthcare in Kenya and is open to anyone over the age of 18 with a jackpot starting at KES100m and two mini jackpots of KES10m each. Meanwhile MyLotto lottery is another lottery

option which is operated by Oxygen8 East Africa Limited. Oxygen8 Group is a global provider of integrated mobile solutions with

offices in 10 countries and operations in 20 countries and a turnover of around £90m. MyLotto (or Lotto Kenya as it is also known)

was launched in November 2015 and saw 2,180 winners in their first draw whilst the number of entrants grew by 300 percent in the first month of the Lotto. Players can choose numbers via SMS, via

Mpresa or online. Tey pick six numbers between one and 49 and a bonus number between one and 10. Top prizes reach KES100m and there are two draws a week on Wednesdays and Saturdays. One line costs KES50. Te lottery contributes to various

organisations and to date has committed over KES15m towards Kenya’s 2016 Olympic preparations. Only those living in Kenya can play and they

must have a verified Mpresa account and players have to be aged 18 years and over. Between 2000 and 2012 there was a big

increase in SMS based lotteries in Kenya. However there is a concern that little is being passed onto charitable causes and talk of many black market operations for some lotteries running and many opened then closed and some branched off into sports betting operations instead. For example the Shinda Smart 6969 was

halted by the government in 2011 and its licence revoked and they have been involved in legal
