CARMARTHENSHIRE COUNTY COUNCIL (BYWAY OPEN TO ALL TRAFFIC 39/5 – LLANWRDA) DEFINITIVE MAP MODIFICATION ORDER 2011
Notice is hereby given pursuant to paragraph 8 (2) of Schedule 15 to the Act that the Inspector appointed by the Welsh Ministers to determine the Order, proposes to modify the Order as follows;
(i) in the preamble to the Order, line 6 after “(3) (c) (ii)” insert “and Section 53 (3) (c) (iii)”;
(ii) in the preamble, line 8 after “description” insert “and that there is no public right of way over land shown in the map and statement as a highway of any description.”;
(iii) Alter Part I of the Schedule to read: PART I MODIFICATION OF DEFINITIVE MAP DESCRIPTION OF PATH OR WAY TO BE DOWNGRADED
Downgrade all of Byway Open to All Traffic (BOAT) 39/5 – From the A482 (point A on the Plan), easterly through Felin Bishop (point B) and across the Afon Dulais via a 1 metre wide timber footbridge (point C) then through a pedestrian gate (point G) then north-westerly along the Afon Dulais to point G1 on the plan (SN 712 322). From point D1 (SN 712 323) in a north-westerly direction along the Afon Dulais through an area of pasture and scrub (point D) before going through a field gate (point I) leading to Goetre (point E) then along a vehicular access track (points E-K- L-M-N-O) to meet county road C2159 between Ty Draw and Pandy (point F) from BOAT to footpath status.

That part of BOAT 39/5 between SN 712 322 and SN 712 323 which has been washed away by the Afon Dulais. (iv) Alter Part II of the Schedule to read:

MODIFICATION OF DEFINITIVE STATEMENT VARIATION OF PARTICULARS OF PATH OR WAY
Amend the Definitive Statement for BOAT 39/5 to read as follows:
“Footpath 39/5 – From the A482 between Danycoed and Felin Bishop, east through Felin Bishop, over a timber footbridge crossing the Afon Dulais then through a pedestrian gate then north-westerly along the Afon Dulais to SN 712 322 (SN 711 321 to SN 712 322).”
“From SN 712 323 in a north-westerly direction through pasture and scrub following the Afon Dulais before turning north away from the river and through a field gate to Goetre then continuing on a track alongside the Afon Dulais to county road C2159 between Ty Draw and Pandy (SN 712 323 to SN 708 327).”
Width Point A to E – 1.4 metres (as per the peck lines on 1906 County Series Ordnance Survey Map) Point E to K – 2.9 metres (as per 1906 OS map) Point K to L – 3 metres (as per 1906 OS map) Point L to M – 2.8 metres (measured width between hedge bank and river bank) Point M to N – 3.8 metres (measured width between hedge bank boundaries) Point N to O – 2.7 metres (measured width between hedge bank boundaries) Point O to F– 3.6 metres (measured width between boundaries) (v)in the Order plan, add the points G, G1, D1, I, K, L, M, N and O.
A copy of the Order, as submitted, and a copy of the Order showing the proposed modifications together with the Inspector’s letter dated 4 December 2012 have been deposited at Carmarthenshire County Council Offices, Business Resource Centre
Parc Amanwy, New Road, Ammanford, and may be inspected free of charge during normal working hours.
Any representation or objection with respect to the proposed modifications may be sent in writing to the Planning Inspectorate, Crown Buildings, Cathays Park, Cardiff, CF10 3NQ, quoting reference number 515584 not later than 28 days from the publication of this notice and should state the grounds on which it is made, and indicate whether you wish to have the opportunity of being heard by a person appointed by the Welsh Ministers at a further public inquiry. It should be noted that any such representation or objection may be made available for viewing by interested parties at the Council Offices on request.

Local Authority Reference RW2/54/CJF NOTICE OF MAKING OF AN ORDER Highways Act 1980 “CARMARTHENSHIRE COUNTY COUNCIL (PUBLIC FOOTPATHS 54/2 & 54/3 – GLASALLT, LLANGADOG) PUBLIC PATH DIVERSION ORDER 2012”
The above Order, made on 6th December 2012, under Section 119 of the Highways Act 1980, will divert parts of public footpaths 54/2 and 54/3 through Glasallt, Llangadog, as shown on the Order map.
A copy of the Order and the order map have been placed and may be seen free of charge at the Countryside Unit, Mynydd Mawr Woodland Park, Tumble, Llanelli, from 9:00 a.m. to 4:30 p.m. on any weekday. Copies of the Order and map may be bought there at a price of 50p. Postal copies may be obtained at a price of £5.00.
Compensation for depreciation or damage for disturbance arising as a result of the coming into force of the Order is payable under Section 28 (as applied by section 121 (2)) of the Highways Act 1980.
Any representations about or objections to the Order may be sent in writing to Mr Ian Jones, Head of Leisure & Sport, Business Resource Centre, Parc Amanwy, New Road, Ammanford. SA18 3EP quoting the above reference, not later than 28th February 2013. Please state the grounds on which they are made.
If no representations or objections are duly made, or if any so made are withdrawn, the Carmarthenshire County Council may confirm the Order as an unopposed Order. If the Order is sent to the Welsh Government for confirmation, any representations and objections which have not been withdrawn will be sent with the Order.

Local Authority Reference RW2/45/CJF NOTICE OF CONFIRMATION OF AN ORDER Highways Act 1980 CARMARTHENSHIRE COUNTY COUNCIL (PUBLIC FOOTPATH 45/19 BRYN, LLANSADWRN) PUBLIC PATH DIVERSION ORDER 2006
On the 14th January 2013, Carmarthenshire County Council confirmed the above Order made under Section 119 of the Highways Act 1980.
The effect of the Order as confirmed is to divert public footpath 45/19 through Bryn, Llansadwrn, as shown on the Order map.
A copy of the Order as confirmed and the Order map have been placed and may be seen free of charge at the Countryside Recreation Unit, Mynydd Mawr Woodland Park, Tumble, Llanelli, from 9.00 a.m. to 4.30 p.m. on any weekday. Copies of the Order and map may be bought there at a price of 50 pence. Postal copies may also be obtained at a price of £5.00.
Any person who wishes to claim compensation under Section 28 (as applied by Section 121 (2) of the 1980 Act for depreciation or damage for disturbance arising as a result of the coming into force of the Order must make a claim in writing to Mr Ian Jones, Head of Leisure & Sport, Business Resource Centre, Parc Amanwy, New Road, Ammanford, Carmarthenshire, SA18 3EP, and serve it by delivering it at, or sending it by pre-paid post to that address not later than 30th June 2013.
The Order comes into force on the 21st January 2013, but if a person aggrieved by the Order wants to question its validity, or that any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the grounds that any requirements of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 of the Act, within 6 weeks from 14th January 2013, make an application to the High Court.
