REDUNDANCY and your SERVICE FAMILY ACCOMMODATION
W
hether you’ve applied for redundancy or been made redundant, one of the things
Service personnel in Service Family Accommodation will need to think about is where they are going to live. Accommodation is a condition of continuing service and JSP 464 sets out the policy for these circumstances. Here DIO have tried to address some of the questions you may have.
If I am leaving on redundancy, can I remain in my SFA, and for how long? You can remain in your SFA until at least your final day of service. However, for personnel compulsory discharged on redundancy with six months or less notice – 93 days ‘continued use and occupancy’ of the SFA will be permitted after the date of discharge at entitled SFA charges. After the 93 days, an extension of up to 93 days may be granted on compassionate grounds. This will require consultation between the Local Service Commander and HASC. This however will be at higher non-entitled SFA charges. Personnel discharged with more than six months notice may apply to remain in their
SFA on a surplus basis for a maximum of six months on payment of market rate.
What happens if I am given a new assignment before redundancy? If you have at least six months to serve at the duty station, you should apply for SFA as normal using the e-1132. For personnel who have been selected for compulsory redundancy, and have been given 6 months or less notice, you will be entitled to SFA at the location where you have been assigned for your last six months or less. If there is no SFA available within a 10 mile radius of that location, DIO Ops Accommodation will offer SFA outside the 10 mile radius. However, you will not be entitled to Substitute SFA (SSFA).
Can I apply for SFA at a different location to my final assignment? Personnel being made redundant may apply for surplus SFA at a location away from their final assignment. This will be at entitled SFA rates but is reliant on the availability of stock.
What assistance can Service personnel in SFA get from Local Authorities? The Minister for Housing and Local
Government wrote to Local Authority Leaders and Chief Executives last year asking them to assist Service personnel who are no longer entitled to SFA. The Minister reminded Local Authorities of the statutory Homelessness Code of Guidance, and that personnel should not be advised to remain in Service accommodation until they are legally evicted. He also reminded them that the Certification of Cessation of Right to Occupy is sufficient for Local Authorities to provide advice and assistance. If you are unable to arrange your own accommodation requirements and need assistance, you should contact the relevant local authority at the earliest opportunity. JSP 464 can be found in the Defence Intranet library and on the DIO website.
