Private prop- erty may only be taken by a gov- ernmental entity, such as a city, or private entity that is authorized by law to take the property for a purpose or use that serves the pub- lic. Texas landowners are protected from authorities taking property to enhance tax revenues or to promote economic development. Property cannot be taken without adequate compensation, including fair market value and possibly damages if the remaining property value is reduced by the purchase, or by the manner the condemning entity will use the property. Ranchers and farmers worry
about how a pipeline may affect their land and livestock. They are anxious about the harm that the taking may have on the remaining property. Negative impacts to im- provements such as fencing, irriga- tion and natural vegetation, as well as access to and moving around the property are legitimate concerns.

fend his holdings against condem- nation proceedings? It pays to be proactive. If the landowner hears rumors about an oil company com- ing to his county or surrounding counties, he or she should learn all he or she can about the company and its plans. How many pipelines will be
built? What size will the pipelines be? What is the time factor for per- mits, environmental impact studies, engineering and surveys? Where will the proposed line be
