Ejecutivo fi rma nueva ley mara modernizar Juegos de azar
Con fecha 7 de mayo, el Poder Ejecutivo de Paraguay publicó el Decreto No. 3846 mediante el cual reglamenta la Ley No. 7438/2025 que modifi ca y amplia la Ley No. 1016/1997, “Que establece el régimen jurídico para la explotación de los juegos de suerte o de azar”, buscando modernizar el sector del juego en el país. El Decreto N.º 3846, fi rmado por el presidente Santiago Peña Palacios, establece reglas claras para la implementación práctica de la nueva Ley que regula la explotación de juegos de azar en Paraguay y además, tiene como objetivo combatir el juego clandestino y mejorar la fi scalización del sector. Quizás el cambio más signifi cativo en la nueva Ley es la creación de la Dirección General de Juegos de Azar reemplaza a la Comisión Nacional de Juegos de Azar (Conajzar), y que ha sido incorporada a la Dirección Nacional de Ingresos Tributarios (DNIT).
La Dirección General de Juegos de Azar como órgano técnico que tendrá a su cargo la implementación y ejecución de las políticas, reglamentaciones y controles con relación a la explotación de los juegos de azar regulados, manteniendo una estructura organizacional que será establecida mediante resolución del Director Nacional de Ingresos Tributarios, previo informe técnico favorable del Viceministerio de Capital Humano y Gestión Organizacional del Ministerio de Economía y Finanzas.
La nueva Ley de juegos de azar actualiza el marco jurídico del sector tras casi 30 años, durante los cuales el ente regulador ha sido seriamente cuestionado y denunciado por acciones que favorecían a particulares, y poniéndole fi n al monopolio de la quiniela y de las apuestas deportivas. Esta decisión fue avalada por la Comisión Nacional de la Competencia (Conacom), en cumplimiento de la Ley N° 4956 de la Defensa de la Competencia.
El nuevo reglamento otorga 30 días a los 263 municipios del país para adecuarse a las nuevas disposiciones y reportar sus permisos vigentes. Esta reestructuración busca fortalecer la capacidad de control del Estado. Asimismo, todos los dispositivos y sistemas deberán contar con la certifi cación emitida por una entidad de inspección debidamente acreditada por el Organismo Nacional de Acreditación (ONA), sin contar con vínculos particulares con el sector del juego. Estas exigencias son obligatorias para operar y recibir apuestas de forma legal.
PARAGUAY Executive signs new law to modernize gambling
On May 7 Paraguay’s Executive published Decree No. 3846, which regulates Law No. 7438/2025 that modifies and expands Law No. 1016/1997, “Which establishes the legal regime for the exploitation of games of luck or games of chance,” seeking to modernize the gambling sector in the country. Decree No. 3846, signed by President Santiago Peña Palacios, establishes clear rules for the practical implementation of the new Law that regulates the exploitation of games of chance in Paraguay and also aims to combat clandestine gambling and improve supervision of the sector.
Perhaps the most significant change in the new Law is the creation of the General Directorate of Gambling – as the new regulator - replacing the National Gambling Commission
(Conajzar), the former regulator, which has now been incorporated into the National Directorate of Tax Revenue (DNIT).
The General Directorate of Gambling is the technical body in charge of the
implementation and execution of policies, regulations and controls in relation to the operation of regulated games of chance, maintaining an organizational structure that will be established through DNIT resolution, following a favourable technical report from a Vice Ministry in the Ministry of Economy and Finance.
The new Gambling Law updates the legal
framework of the sector after almost 30 years, during which Conajzar has been seriously questioned and denounced for actions that favoured individuals. The new Law also puts an end to the monopoly of betting pools and sports betting. This decision was endorsed by the National Competition Commission (Conacom), in compliance with Law No. 4956 based on the Defence of Competition.
The new regulation grants 30 days to the country’s 263 municipalities to adapt to the new provisions and report on current permits issued. This restructuring seeks to strengthen the State’s capacity for control. Additionally, all devices and systems must have the certification issued by an inspection entity duly accredited by the National Accreditation Organization (ONA), which does not have any particular links with the gambling sector in Paraguay. These requirements are mandatory in order to operate and receive bets legally in the country.
