Ejecutivo presentó ante la Comisión de Economía del Senado proyecto de ley online


Con fecha 17 de enero 2024, la subsecretaria de Hacienda, Heidi Berner, presentó a la Comisión de Economía del Senado, junto con la superintendenta de Casinos de Juegos Vivien Villagrán, el proyecto de ley que regula el desarrollo de las plataformas de apuestas online, que fue aprobado en primer trámite por la Cámara de Diputadas y Diputados, en diciembre pasado.


Los principales objetivos de esta iniciativa son generar un mercado competitivo considerando la existencia de otras formas de juego legales (sorteos de Lotería, números de Polla/Lotería y carreras hípicas de caballos fina sangre); resguardar la fe pública; proteger la salud y la seguridad de las y los jugadores; así como transparentar los orígenes y destino de los recursos obtenidos por esta actividad y contribuir a la recaudación fiscal. La autoridad detalló que el marco legal aprobado en la Cámara de Diputadas y Diputados crea un mercado semiabierto, donde —al igual que en el caso de los casinos de juegos— los operadores deberán cumplir requisitos formales como constituirse en


sociedades anónimas cerradas en Chile, con objeto exclusivo, capital mínimo de 2.000 UTM (US$ 140.000) y un máximo de 10 accionistas, los que deberán identificar sus beneficiarios.


El diseño regulatorio contempla la entrega de una autorización administrativa y equilibra incentivos a la regularización con severas sanciones a quienes se mantengan en la ilegalidad, otorgando nuevas atribuciones a la Superintendencia de Casinos de Juegos, la Comisión para el Mercado Financiero (CMF), el Servicio de Impuestos Internos (SII), la Subsecretaría de Telecomunicaciones y la Unidad de Análisis Financiero (UAF). Acotó que, dado que las plataformas deberán dar acceso remoto a sus sistemas, tanto a la Superintendencia de Casinos de Juegos como al SII, se podrá ejercer una fiscalización efectiva. La ley entraría en vigencia a contar del primer día del mes siguiente al de su publicación en el Diario Oficial, dotando a la administración de herramientas de persecución al juego ilegal y desde esa fecha las plataformas de juego en línea que no hayan operado en Chile en los últimos 12 meses previos podrán postular a licencias transitorias. Las normas relativas a solicitud de licencias generales para explotar apuestas en eventos únicos empezarían a regir una vez dictado el reglamento, lo que deberá efectuarse en un plazo máximo de seis meses desde la publicación de la ley. Las plataformas que obtengan una licencia transitoria de operación deberán pagar el fee anual de operación, además de la obligación que les corresponda con la obtención de una licencia general y sin perjuicio de la aplicación de los demás impuestos y gravámenes

Executive presented online bill to the Senate’s Economy Committee


On January 17, 2024, the Undersecretary of the Treasury, Heidi Berner, presented to the Senate Economy Committee, as well as to Vivien Villagrán, president of Superintendencia de Casinos de Juego (SC), the bill that regulates the development of online betting platforms, which was approved in the first stage by the House of Representatives, last November. The main objectives of this initiative are to generate a competitive market considering the existence of other forms of legal gambling (lottery draws, raffles and horse racing); in order to safeguard the public; protect the health and safety of players; as well as making transparent the origins and destination of the resources obtained by this activity and contributing to tax revenues.


The authority


explained that the legal framework approved in the Lower House creates a semi-open market, where — as in the case of casinos — operators must meet formal requirements, such as being incorporated in closed corporations in Chile, with specific purposes, minimum capital of 2,000 UTM (US$ 140,000) and a maximum of 10 shareholders, who will have to identify their own beneficiaries.


The regulatory design of the bill contemplates the delivery of an administrative authorization pairing up incentives for regularization with severe penalties for those who remain illegal, granting new attributions to the SCJ, the Financial Market Commission (CMF), the Internal Revenue Service (SII), the Undersecretary of Telecommunications and the Financial Analysis Unit (UAF). Additionally, given that the platforms must give remote access to their systems, both SCJ and SII should exercise effective control. The law would come into force on the first day of the month following its publication in Chile’s Official Gazette, providing the administration with tools to prosecute illegal gambling. From that date online gambling platforms that have not operated in Chile in the previous 12 months will be able to apply for transitory licenses. The rules relating to the application for general licences to operate bets on single events would come into force once the regulations have been issued, which must be done within a maximum period of six months from the publication of the law. Platforms that obtain a transitory operating license must pay the annual operating fee, in addition to the obligation that corresponds to them to obtain a general license and without prejudice to the application of other taxes and levies established in this law.
