Business Coalition urges Ghana to scrap new gaming taxes
Ghana’s Coalition of Small Business Owners had urged the government to scrap changes to its Income Tax Amendment Bill that its believes willhamper growth in the country’s gaming industry. The Income Tax Amendment introduces changes to
the taxation of winnings from betting and other games of chance as well as the taxation of companies involved in lottery operations in Ghana. Imposition of Withholding Tax on Winnings from
Betting and Games of Chance: Previously, a withholding tax of 8% was applied to
lottery winnings sourced in Ghana, but it did not cover winnings from betting and other games regulated by the Gaming Commission. To address this, the Income Tax Amendment replaces the withholding tax on “lottery winnings” with a tax on “winnings from lottery,” which now includes betting, gaming, and other games of chance. The new withholding tax rate has been

increased to 10% of gross winnings at the end of each game. Taxation of Companies Involved in Lottery
Operations: The amendment also brings significant changes
to the taxation of companies engaged in lottery operations. These entities will now be subject to a tax rate of 20% on their gross gaming revenue, defined as the total amount staked or wagered minus prizes or winnings paid out. This means that the expenses of such companies related to their lottery operations will no longer be deductible when calculating their income tax liability. Additionally, income from the entity’s lottery operations will be separately charged from its other earnings, which will follow the general regime for determining the company’s chargeable income for a specific assessment year.
