However, the Road Transport (Working Time) Regulations 2005 stipulate a maximum of 48-hour average week (there is no opt-out) and provides mini- mum levels of breaks, and limit night work as follows:-


• 30 minutes if daily working totals six to nine hours • 45 minutes of breaks if working over nine hours • if night work is performed, daily working time should not exceed ten hours in a 24-hour period


So in effect if this was to come in, you could start filing for bankruptcy now, especially if you are a night driver; and of course that in turn will destroy the city night life the length and breadth of the country - unless of course all the ex-taxi drivers volunteer to become night bus drivers. Yes, it may well be that you would like to respond to this consultation as well. In fact, I strongly believe you should.

Today the Department for Transport is publishing a consultation docu- ment seeking views on proposals to review the list of designated bodies for ‘section 19’ community transport permits.


The Government recognises that designated bodies play an important role in the community transport sector, not just in the processing of permit applications, but also in providing important advice and guid- ance to their members; we are keen to support this.


The consultation document begins by setting out some background to the designated bodies system and explains why the Department is looking to review it. It then describes the Government’s proposals for taking forward the review and poses a number of questions for con- sultation.


The consultation closes on Wednesday 14 October. If you would like further copies the document it can be found at: http://www.dft.gov.uk/consultations/open


I hope you will contribute to the process; all submissions are carefully considered and will help to inform our decisions on how to proceed with the designated bodies review. A summary of consultation responses, along with our formal response, will be published on the DfT website in late 2009. This will also include our final proposals.
