Response to Bedding In!


Despite all the hard work that went into formulating the Landfill Tax (Qualifying Fines) Order 2015, which came into force in April 2015, the new legislation does not appear to be having the desired effect of the Government-Industry Working Group, of which UROC was a contributor. The idea behind the Order was to provide confidence for Landfill Operators to accept fines originating from waste transfer stations.


There have been mixed responses from our members in relation to our questionnaire “Bedding In?” There appears to be a number of operators across the country who are incurring real difficulty in finding landfill operators willing to accept trommel fines, even if they pass the LOI test and meet the requisite criteria. It is apparent that there are certain pockets in the UK where there is more reluctance to accept trommel fines than there is in other parts.


That said there are a number of members that are


benefitting from the new Order and have found that by meeting the LOI test and complying with requirements the Order is proving to be a success, as they are able to demonstrate that they can comply and dispose of this waste type at lower rate tax.


There are some issues for those who are able to


find legitimate disposal outlets which include; » The turn around time on laboratory testing » Differences in LOI test results


» Landfill Operators limiting the amount of fines they will accept at any one time


» Disproportionate gate fees


» Constant threat of a load being retrospectively charged at standard rate tax


The 15% LOI was negotiated


by UROC for a 12 month transitionary period – so come April 2016, it will be reduced to 10%. Therefore, it is so important that you make contact with us and feedback on how the new regime is working for you. Any information you provide will be held in the strictest of confidence. We need to provide evidence to HMRC on how the new Order is working and if it is not totally effective then we need to back it up as to why!

UROC has had feedback from


some Landfill Operators that have stated their concern is that the risk is too high for them and they feel that HMRC is waiting to ‘pounce’ on them to recoup vast amounts of landfill tax, which would result in difficulty for Landfill Operators to recover from Mechanical Operators and possibly result in satellite litigation.
