What is the impact of the health and safety sentencing guidelines on you and your business?
On 1st February 2016, the Sentencing Council’s guidelines for health and safety, corporate manslaughter and food safety offences came into effect. The implications of the guidelines are significant for any organisation and director, manager, supervisor or employee.
If found guilty of a relevant H&S offence, the court will consider the gravity of the offence (taking into consideration the harm risked and the likelihood of it arising) and the culpability of the organisation concerned to determine the appropriate range of sentences and starting points for fines.

Individual company directors who are found guilty of “consent, connivance or neglect” will face
potentially unlimited fines and terms of imprisonment of up to two years.
Recent prosecutions have seen fines and custodial sentences increase considerably and are a timely reminder of the consequences of a failure to ensure adequate health and safety as well as the damage that can be caused to the reputation of an organisation.
Organisations should immediately risk-assess and review existing systems and procedures to ensure health and safety compliance and ensure all staff are appropriately trained and supervised. It is also vital that organisations ensure appropriate records are kept.
