Your Local Legal Magazine Buying a car in Spain Brand new: by Ana Gay

The price is the most important point when purchasing a brand new car. Have a good look around as the prices for the same car vary from dealer to dealer.

If the car you want is unavailable then an order form will have to be filled out, normally drafted by the car manufacturer. In this case do not ever sign a blank order form.

Make sure that the

final figure is reflected and that there are no hidden extras, and that the deposit that you leave is also clearly stated.

The characteristics of the car should be fully listed. Do not accept clauses whereby the vendor may change the conditions. If you part exchange your old vehicle ensure you are given a copy of the sale contract so that you can notify the traffic department and the Town Hall of the change of owner. If this isn't done you will continue to be liable for the car tax.

When you are given the car the dealer should give you the following documentation: ·

The circulation permit

· The ITV (MOT) card ·

· A written guarantee ·

The instruction and maintenance manual The invoice

You will need to take out insurance for the car and the car tax will have to be paid to the town hall.

Second hand: Documentation to be supplied by the vendor:

· Proof of payment of the car tax ·

The circulation permit

· Technical specification card where the ITV (MOT) inpsections are marked on the reverse

The notification of vehicle tansfer form should be filled out and signed by both vendor and buyer, as well as the application for transfer that should be presented at the traffic department along with the above mentioned documentation.

If you purchase from a used car dealer, they will normally take care of the transfer.

Once the transfer tax is paid the traffic department will issue a new circulation permit in the new owner's name.

Costs. Apart from the transfer tax, a fee is payable to the traffic department for processing the change of owner.

If the sale is a private one, the vendor has 10 days in which to notify the traffic department of the transfer. The buyer on the other hand has 30 days in which to complete the transfer.
