ETA Proposes Regulation Establishing Occupations that Regularly Conduct Drug Testing Te Employment and Training Administra- tion (ETA) of the U.S. Department of Labor (DOL) proposes to establish in regulation, for State Unemployment Insurance (UI) program purposes, occupations that regularly conduct drug testing. Tese regulations would implement the Middle Class Tax Relief and Job Creation Act of 2012 (the Act) amendments to the Social Security Act (SSA), permiting States to enact legislation that would allow State UI agencies to conduct drug testing on unemployment compensa- tion (UC) applicants for whom suitable work (as defined under the State law) is only avail- able in an occupation that regularly conducts drug testing (as determined under regulations issued by the Secretary of Labor). States may deny UC to an applicant who tests positive for drug use under these circumstances. Te Secretary is required under the SSA to issue regulations determining those occupations that regularly conduct drug testing. Comments were due December 8, 2014.
DATIA will provide any necessary updates on this regulation.
DATIA Comments on OSHA NPRM to Change Tracking of Workplace Injuries & Illnesses DATIA actively supports initiatives to promote drug-free workplaces thereby increasing workplace safety. Drug-free workplaces are a key component in creat- ing safe and healthful working conditions, however, new changes included in the August 14, 2014 amendment seriously threaten the ability of employers to main- tain a drug-free workplace.
