A common means of achieving this is to stipulate that the surviving partner can occupy the house without ownership being transferred outright. This ensures that the deceased partner’s share of the property will then pass to their children on the partner’s death, a condition that can only be changed with the children’s consent.
The same thinking can be applied to other assets. For example, specifying a life interest trust will provide your spouse with a regular income but protects the underlying capital for your children.
