LEAD RENOVATOR, REPAIR AND

CONTENT: The EPA now requires anyone who is paid to perform work that disturbs paint in housing and child-occupied facilities built before 1978 to be trained as certified renovators and follow prescribed lead-safe work practices. The EPA is authorized to enforce penalties of up to $37,500 per violation, per day. After attending this course, you will be able to: Describe lead-related health problems, why it's a problem, and who is at risk Recognize EPA and HUD rules required of Certified Firms and Renovators Determine if lead-based paint affects your work, and how to educate customers about how the work will affect their property
Properly set up work area so lead dust/debris don't contaminate the property Identify how to work in a lead-safe manner, what practices are prohibited by EPA and/or HUD rules, and information on personal protective equipment
Effectively clean up dust generated by the work performed, conduct a cleaning verification, dispose of renovation waste
Indicate requirements for creating and maintaining documentation of work. Train non-certified renovation workers in lead safe practices while on the job.
WHO SHOULD ATTEND? General contractors, remodelers, painters, plumbers, carpenters, electricians, HVAC contractors, window replacement companies, and anyone working in pre-1978 housing and child-occupied facilities.

CONTENT: Come and get the latest information from our distinguished panel of speakers. This discussion will cover the many changes happening in the residential home building industry. This is a must see for all builders and remodelers.
STEVE PAXSON will review the Residential Construction Liabilities Act (RCLA) and comment on the Construction Trust Fund. He will cover contracts, warranties and address the indemnity limitations. Steve is a shareholder and president of Paxson & Associates, P.C. and has been practicing law in excess of 35 years. He has been engaged in a general civil practice involving the negotiation, documentation, as well as the litigation, arbitration and mediation of construction, banking, real estate and commercial contract matters. For nearly 25 years, Steve’s practice has focused on the representation of parties (owners, contractors, subcontractors and suppliers) in drafting contracts and related forms and handling construction defect claims related to residential and light commercial projects, as well as providing general legal counseling and litigation avoidance strategies.
JOHN KRUGH will discuss the 2011 HOA Reform Laws for Texas. There is a new Texas two-step for the POA and HOA dancers. The 82nd Legislature made significant changes to homeowner association laws. This presentation will review the highlights of those changes and provide you with tools to navigate the new water in which property owners associations will be operating. John Krugh practices in the areas of real estate, residential construction, dispute resolution, corporate law, general business matters and employment matters. He obtained his law degree from South Texas College of Law. For 22 years John was general counsel for Perry Homes. For good or for bad (depending on your point of view), John was one of the initial members of the Texas Residential Construction Commission.

CHRIS RYMAN will present an overview of key provisions of RCLA and case law update. Chris has been a director with Coats Rose in Texas since 1990. For more than 20 years, Chris has represented clients in federal and state courts in general civil litigation matters, in addition to construction, commercial, business and real estate litigation (with an emphasis on construction defects litigation). Chris was a participant in legislation relating to the Texas Residential Construction Liability Act. He has also been actively involved in legislation regarding Texas residential construction.
STEVE TOBIN will speak on the new M & M lien laws as well as some of the recent OSHA developments. Before H.B. 1456, lien waivers came in many forms. As of January 1, 2012, however, lien waivers will only be enforceable if they substantially comply with the form prescribed by the statute and are notarized. Get to know the differences between the four forms allowed by the statute, learn how to phase the new forms into your business before the January 1 effective date, and glean strategies for using the forms to protect yourself against sub-tier lien claims. Stephen Tobin is an attorney with Paxson & Associates, P.C., where he focuses his practice primarily on counseling clients in residential construction and real estate transactions, dispute resolution and copyright matters. Stephen graduated cum laude from the University of Arizona, James E. Rogers College of Law.
