New Gambling Commission requirements for customer- led financial limits and transparency on protection of customer funds


Almost one year after it closed for responses, the Gambling Commission has finally published the outcome of three of the four outstanding parts of its Autumn 2023 consultation exercise. Northridge Law’s Melanie Ellis reports.


key topic in the Autumn 2023 consultation was that of socially responsible incentives, in particular the proposal to ban or significantly curtail the ability of operators to apply wagering requirements to bonuses. The Commission’s final decision on this topic is promised by the end of March.

The three issues now settled are proposals for customer-led tools, improved transparency on customer funds in the event of insolvency and removing obsolete requirements due to the upcoming statutory levy.

The third of these simply involves removing the requirement for operators to make an annual contribution to a responsible gambling organisation, from April 2025 when the statutory levy will come into effect. The first two are outlined below.


CUSTOMER LED TOOLS In the consultation, the Commission sought views on options for updating existing requirements in the Remote Technical Standards on providing online customers with the ability to set themselves financial limits at account level. Currently, the system


needs only provide easily accessible facilities that make it possible for customers to set limits if they wish to and also to present the opportunity to set a limit at registration or first deposit.


The two options under consideration were: a) financial limits presented to new customers as the default option, with the ability to opt out, or b) requiring all new customers to set a financial limit.


The Commission’s final decision was to adopt option a), so that financial limits will need to be presented to all new customers with setting a limit as the default choice.
