CHILE – La SCJ reinicia el proceso de permisos para casinos
La Superintendencia de Casinos de Juego (SCJ) emitió una nota de prensa, con fecha 24 de mayo de 2021, anunciando que, “reinicia el proceso de otorgamiento o renovación de permisos de operación de casinos de juego, iniciado el 27 de julio pasado y suspendido por 270 días, con lo cual la nueva fecha de la audiencia de presentación de las ofertas técnicas y económicas será el 18 de octubre de 2021, a las 10:00 horas en el Hotel Gran Palace de Santiago”. Entre los casinos que entran en el proceso con permisos que
vencen desde el 2023, se encuentran: Sun Monticello, Marina del Sol, Enjoy Antofagasta, además de los casinos Dreams en Temuco, Valdivia y Punta Arenas. El concurso ha sido
cuestionado por operadores de la industria que piden que se realice según reglas establecidas cuando se otorgaron las concesiones, en 2005, que otorgaba a los operadores autorizados un derecho preferente en la renovación los permisos para sus casinos; además de severos cuestionamientos por el supuesto favorecimiento del Gobierno a la empresa Enjoy, no solo con relación a su restructuración judicial, sino también con medidas para prorrogar compromisos con El desarrollo de los casinos municipales en Coquimbo, Viña del Mar y Pucón, otorgados por licitación a le empresa líder de casinos en Chile.
URUGUAY- Se prorroga la licitación del Hotel Casino en Rocha
Con fecha 7 de mayo, el Ministro de Turismo, German Cardoso Ferreira firmó la Resolución EXP. 2021-9-1-0000149, prorrogando el llamado internacional para la licitación del hotel casino de Rocha, en el sureste Atlántico de Uruguay, hasta el mes de agosto, por considerar que “en virtud de distintas consultas manifestadas por algunos grupos inversi0onistas respecto al Pliego de Condiciones, Asesoría Técnica entiende prorrogar la recepción y apertura de las propuestas”. El punto único de la resolución, indica que se prorroga
para el día 20 de agosto, “en las mismas condiciones que el llamado original, la apertura de propuestas del Llamado Internacional a presentación de Expresiones
de Interés bajo el régimen de iniciativa privada Ley No. 17.555 de fecha 18 de setiembre de 2002, convocado para la Concesión y Exp0lotacion de un Hotel y Casino privado en la Costa Oceánica del departamento de Rocha (La Paloma - Chuy). En febrero, el Ministerio de Turismo y la Intendencia de Rocha,
convocaron a expresiones de interés de alcance internacional para la construcción del hotel casino en La Paloma y Chuy, con el objetivo de diversificar la oferta turística y generar trabajo en el departamento. Entonces, el llamado se extendió por 90 días, enmarcado en el régimen de iniciativa privada establecido en los artículos 19 y 20 de la ley n.° 17.555 y el decreto reglamentario n.º 442/002.
CHILE – REGULATOR RESTARTS CASINO PERMIT PROCESS
In a note published on May 24, 2021, Chile’s casino regulators, Superintendencia de Casinos de Juego (SCJ), stated the restarting of “the process of granting or renewing operating permits for gambling casinos, initiated on July 27, and suspended for 270 days, and setting the new date for filing documentation of technical and economic offers for October 18, 2021, at 10:00 a.m., at the Hotel Gran Palace in Santiago, as indicated in Resolución Exenta N° 746 of 24 November 2020.″
Amongst the casinos to enter the new licensing process, with permits to end in 2023, are: Sun Monticello, Marina del Sol, Enjoy Antofagasta, plus Dreams casinos in the cities of Temuco, Valdivia and Punta Arenas. The new licensing process has been challenged
by industry operators who are calling for it to be conducted according to rules established when the concessions were granted, in 2005, that indicate that authorized operators have a preferential right in the renewal of permits for their casinos. Also, the Chile government was criticized for authorizing Decree 77, which grants an extension in the development and construction work to certain operators, specifically as a measure to benefit the Enjoy group. However, reports indicate
that on April 28, executives of local Banco Internacional - Enjoy’s creditors - met with the head of the SCJ Legal Division, Manuel Zárate, to dispel doubts about the situation of the municipal casinos in Coquimbo, Viña del Mar and Pucón, granted by SCJ in a 2020 public tender process to Enjoy, inquiring whether the economic offer for these casinos could be changed and paid monthly, upon which, the SCJ responded in negative.
URUGUAY – Government extends tender date for Rocha Hotel Casino
On May 7 the Minister of Tourism, German Cardoso Ferreira, signed the EXP Resolution 2021-9-1-0000149, extending the international call for tenders for the Rocha casino hotel, in the southeast Atlantic of Uruguay, until August. “By virtue of several consultations with different investment groups regarding Tender Conditions and Technical Advice, we have to extend the reception and opening of proposals for the hotel casino.” The single item in the resolution indicates that the date of extension to August 20, applies “under the same conditions as the original call for the presentation of Expressions of Interest under the regime of private initiative Law No. 17.555 dated September 18, 2002,
convened for the Concession and Operation of a Private Hotel and Casino on the Oceanic Coast of the province of Rocha (La Paloma - Chuy). In February this year, the Ministry of Tourism and the Municipality of Rocha called for the casino hotel in La Paloma and Chuy tender, with the aim of diversifying the tourist offer and generating work in the province they extended the tender for 90 days according to current legislation.
