Condemnation Commission


Section6.030. 1. There shall be a permanent condemnation commission


composed of threemembers and three alternates all of whomshall hold no other county office and shall be residents of the county. They shall be appointed by a majority of the circuit and associate circuit judges of the county at a meeting duly called and held for that purpose, but if the circuit and associate circuit judges fail to make an appointment within thirty (30) days after a vacancy occurs the county executive shall make the appointment subject to confirmation by the council. All members and alternates shall serve overlapping termsofthree years except thoseappointed to fill a vacancy occurring during the termof any member or alternate. Not more than two members and one alternate shall belong to the same political party. 2. Members shall receive such compensation as may be


established by ordinance. Alternates shall receive no compensation except for such times as they may be actively engaged in the work of the commission, for which they shall receive the same compensation as a member. 3. The commission shall assess the damage and benefits in all


condemnation proceedings brought by the county and in any other condemnation proceeding in which the judge before whom the proceeding is pending so orders. 4. The commissionshalldesignate oneof itsmembers as chair and


shall adopt such rules and regulations for the conduct of the business of the commissionaswill not be inconsistentwith laworwith the rules of the circuit court. 5. Nothing herein contained shall abrogate the right to appeal


from any commission award in condemnation in the manner provided by law nor the right to trial by jury.
