THE SECRETARY OF STATE FOR ENVIRONMENT. FOOD AND RURAL AFFAIRS:-


1. is satisfied that United Utilities Water PLC, “ the Company” , in supplying water from Walchgate water treatment works which has contamed exceedences o f the prescribed total and faecal conforms parameters and is likely to do so again, has contravened its duty


in respect o f supplying water which meets the Regulations under Section 68(l)(a) o f the Water Industry Act 1991 and meets the requirement set m regulation 3(7) o f the Water Supply (Water Quality) Regulations 1989.


2. has notified United Utilities Water PLC on 20 A p r il 2004 that she is considering making in relation to the Company an enforcement order uruier Seclion.18 o f the Water Industry Act 1991.


3. notes that United Utilities Water PLC has on 6 August 2004 given an undertaking under Section I9 (l)(b ) o f the Water Industiy Act 1991 to take the following steps by the dates shown:-


(a) Submit to the Secretary o f State a draft drinking water safety plan (DWSP) to ensure the continued and ongoing commitment to the assurance o f the quality o f water leaving Watchgate WTW for the duration o f the undertaking.

(b) Review and critically evaluate each step o f the regulatory sampling arrangements (including sample line, sampling tap, and sample tnmsportation arrangements) and the analysis process for coliform bacteria and implement any remedial actions identified. To be completed by 30 September 2004


(c) Cany out a holistic programme o f investigation in accordance with the DWSP and sampling protocol to identify any deficiencies in the treatment processes. Investigations to include:


(i) Operational sampling for coliform bacteria, E.coli, Enterococci and Clostridium perfringens at each key stage o f treatment. (ii) Efficacy o f the filtration process in terms o f microbiological perfonnance, including: (a) Condition o f filter media; depth and cleanliness.


(b) Filtered water turbidity values, including trending o f individual filters.


(c) A i r scour and backwash process, determining the efficacy o f the backwashing process by taking large volume samples before and after bachvashing with analysis to include, but not be limited to, colifomi bacteria, E.coli, Enterococci and Clostridium perfringeiis.


(iii) Efficacy o f the disinfection process, including:


(a) Pre- and post chlorination, using large volume ^mples for analysis as described in step (ii)(c) above and also enterovimses using tissue culture techniques, as appropriate to risk.


(b) Establish and verify the Ct value for the disinfection process. (c) Establish and verify pH target values for the disinfection process. To be completed by 28 February 2005 (d) In light o f the above investigations undertake appropriate remedial action to facilitate compliance with the required


standards. Once the improvements have been made to the backwash recycle process conduct a further investigation, as described in steps (c) (i), (c) (ii) (b) and (c) (iii).


To be completed by 28 February 2005


(c) Submit to the Secretary o f State a statement to demonstrate that compliance has been achieved following completion o f the remedial work earned out under (d).


To be completed by 31 August 2005


(0 Implement the drinking water safety plan and monitor the coliform bacteria and E.coli parameters at a frequency o f - 365 samples per annum at the outlet o f the WTW. I f any sample contains colifonn bacteria and/or E.coii:


(i) examine a further sample from the same location as the original sample and samples from related points, with analysis as described in step (c)(i) above;


(ii) undertake large volume sampling, with analysis as described in step (c)(i) above; (iii) conducting immediate checks on: (a) the operation o f the treatment works; (b) any contamination o f the distribution system; (c) A i r any contamination o f raw water at source; (d) the sampling tap and sampling and laboratory procedures. For the duration o f the undertaking


(g) Where the investigations in (0 indicate actual or potential microbiological contamination o f the water leaving the works, implement appropriate remedial action, including as appropriate:


(i) increasing the disinfectant dose at the treatment works; (0


(ii) (iii)


(ii) correcting the operation o f treatment works including filtration and disinfection; ( iii) isolating and where appropriate conecting any identified source o f water contamination; (iv) taking measures to protect raw water sources; and (v) take all appropriate means to protect public liealth in consultation with the Health Protection Agency and local authority. For the duration 'of the undertaking (h) A t regular intervals provide DWI with reports on progress made with canying out this project. Reports to include at least the following details: Details o f programmes o f work including commencement and completion dates for investigations, design, tendering, constmetion, commissioning and beneficial use; Current state o f progress with programmes o f work in (i) above; A full report on the outcome o f the review carried out under step (b) and a full report on the outcome o f the investigations carried out under step (c) above;


(iv) A statement o f the implications o f any slippage o f the programmes in (i) above; (v) Details o f the prospect o f recovery o f any slippage mentioned in (iv) above, including degree to which slippage is expected to be recovered and how it w ill be recovered;


(vi) Whether the Company has any reason to believe that it will not be able to meet any o f the key dates in the undertaking; and


(vii) Results o f all monitoring undertaken in step (0 above. Beginning 31 August 2004 and a t 2 calendar months thereafter for the remainder o f the Undertaking

4.3 Mai order advertisements wifl not be accepted lor pubGcaEon by the Company unless the Advertber completes and returns to the Company a Mail Order Guarantee Form, produced by the New’spaper Society, prior to the deadTme tor publication of the adv’ertbemenl 5


Requests for Insertion on Particular Dates in Particular Sections


Whilst the Cevnpany will endeavour to comply with reasonable r^ e s ts for an advertisement to be inserted on a particular date or in a particular part or edition of the publication, or to be inserted under a particular dassif icatbn, the C om p ^ makes no guarantee in re ^ o ^ of any such request. 6

7 Copyright 7.1 Copyright of all artwork, copy or other material created, reworked or contn'buted to by the Company shall vest in the Company. 7.2 The Advertiser authorises the Company to record, reproduce, pubibh, distribute and broadcast (or to permit the same) all advertbemenls findudng but not limited to text artwork and p^Kiti^raphs] and to indude and make them avalable in any information service, electronic orotherwise. - 6 Advertiser's Property Held at Advertiser's Risk - AJI aitwork, photographs, film or other property delivered by the Adveriber to (he Corripany b held by the Company at the Advertber's risk and the Advertiser should insure all such property against loss or damage whatsoever cause. The Company reserves the tight to destroy vrthout notice aB artwork, pholographs. film or other property wh'ich has been in its custody lor six months from (he date of its last appearance in an advertisement, unless the Advertiser has given written instrucb'ons to the contrary. 9 Box Numbers 9.1 The Company will endeavour to forward all replies to a box number, to the Advertor, as soon as possiile after rece'pt. but the Company accepts no liability in respect of any loss or damage alleged to have risen t h ^ h delay in forwarding or omitling to forward such repSes. - howsoever caused. 2 Rates


2.1 The rates charged for the insertion of advertisements shall be those set out in (he Compan/s rate card in force at the bme the Older bp^ced. 3 Advertising Agencies


3.1 Com irx s ^w E lo r^ be granted to agencies formally recognised by the Newspaper Society or the Company at the time ot placing the order. The rate of commission payable will be determined by Ihe Cempany any may be varied or withdrawn at the Comparr/s dbcretkxr at any time, s u t ^ to ghing the advertbing agency seven days wnnen notice thereof.

4.2 Save as provided lor under Clause 4.1 above, payment shall be made (or each advertisement within seven days ol the dale of the invoice, except that payment of advertbements charged to an approved credit account shall be made no later than ifiirty days after invoice. Should the Adveitber be in breach of these terms, or of any contract with the Company, then the fun amount in respect of aD adveribing published and aD other amounts accruing from the Advertiser shal become due and payable.


4.3 The Company reserves the right to withdraw aedtl (aolies from any Advertiser al the

4.4 All payments must be accompanied by the remittance advice issued by the Company.

12 Assignment


12.1 The Company Shan be entitled to assign its contract with the Adverdser or any of its rights or benefits thereunder lo any other company within the gr«4) of Johnston Press pic.
