LONDON BLACK CAB DRIVER CLEARED OF RAPING YOUNG CITY WORKER IN HER FLAT
A black cab driver has been cleared by a jury of raping a drunken passenger in her flat after taking her home. The Daily Mail reports that David Jacobs, 61, was accused of sexually assaulting the City worker after collecting her from Fleets near St Paul’s Cathedral in February. The woman, in her 20s, drank ten glasses of wine and a beer in three hours before she was helped into Jacobs’ taxi by colleagues. CCTV was shown of the woman falling backwards in the bar while collecting her bag and coat. During the journey home, she recalled becoming “upset” at which point her driver, Jacobs, began to speak with her. She noticed that the conversations were going in strange ways, it was becoming suggestive,” prosecutor Amanda Hamilton said. The woman recalled telling Jacobs that she wished to kill herself and later told police officers “she wasn’t being suggestive towards him in any way and felt that she was having a mental health episode.” Ms Hamilton continued: “She can’t remember what he said but she knows he asked her to show him her breasts and that’s what prompted her to press the record button on her phone.” During the recording, played to jurors at Inner London Crown Court, Jacobs can be heard saying ‘You might as well let me f*** you’. The woman responded “So what, so you mean if I want to die I would let you f*** me” to which Jacobs replied “Yes, because you don’t care do you.” The woman claims to have no

recollection of arriving home, but recalled Jacobs was “on top of her penetrating her vagina with his penis.” “She doesn’t remember get- ting out of the taxi or entering her home,” Ms Hamilton said. “She remembers a large old man who pulled her work dress over her head. She could hardly stand when this was happening.” She continued: “She told him she had to go to sleep and get up to work and he told her he would soon be finished and carried on.” The woman then “blacked out” and could not recall what time he left. Shortly afterwards, she sent her friend a voice note to say “there had been an old man in her flat and that he’d done things to her.” She woke at 6am feeling “anxious, confused and violated” and discovered her cushion on the floor covered in vomit. Jacobs, who has worked as a taxi driver for more than 20 years, claimed his fare became flirty very quickly as she allegedly showed her breasts to him to which he admitted asking ‘are they yours?’. Jacobs maintained that the woman consented to sexual intercourse at her flat. Ms Hamilton told jurors that Jacobs was married with two children who are older than the victim “and so you seriously expect us to

staggering woman invited him in. “He wants you to believe that he is a victim of a flirty attention seeking seducer who has set him up and that’s why he is here and that’s the bed rock on which he has built his arguments, this was all her plan.” But Rhiannon Crimmons, KC, defending Jacobs, told the jury: “How many times in your life have you heard people say ‘I can’t believe I did that’ ‘omg I cant believe that’ after a night out?” She said: “People make bad decisions when they’ve been drinking all the time, whether or not someone regrets that situation is neither here nor there. “There is no requirement the consent be verbal it can be from acts or behaviour. “It is not rape for a man to have sex with a woman who has been drinking. “The question is what she could understand, that doesn’t change regardless of if the man was sober or drunk, just because a woman has been drinking it doesn’t mean a man can’t have sex with her. “I’m not saying David Jacobs is any kind of saint, quite evidently he is not, he is a married man, he hurt his wife, his family, he’s lost his job. “He will not work as a black cab driver again, he should never have had sex with a passenger no matter what she said or did and of course he will pay for all of that he will have
to rebuild the
relationships. “In his family he is in his own words at the very least a fool, but he is not a rapist.” Jacobs, of Barking, east London, denied and was cleared of rape.
