Massive fines for estate agents advertising properties without energy performance certificates by Catalonian government

The “Generalitat de Catalunya” Catalonian Government (Catalonia is located north of Valencia), through the Catalan Consumer Agency (ACC ) has officially published (12th of January of 2016) that disciplinary proceedings have started against 42 real estate agencies for advertising properties without having the obligatory Energy Performance Certificates (EPC). We are waiting to receive confirmation of whether these fines are also to be extended to the property owners.

The Public Department informs that inspections found these agencies advertised properties without the obligatory energy label, in violation of the law and the rights of consumers.

In some cases, estate agents have been advertising that the certificate is “pending”, as a mechanism to avoid the obligation. But authorities informed that the 42 fining processes started subsequently, after the agencies failed to demonstrate that the certificate was being processed, according to sources of the ACC.
