MDDUS head of dental division Aubrey Craig and his team of experienced dento-legal advisers provide assistance with patient complaints, claims of negligence and referrals to the GDC.
With more than 100 years of experience assisting members, MDDUS is a mutual defence organisation founded by and for healthcare professionals, with an expert staff of dentists, lawyers, employment law and risk advisers who are leaders in the dento-legal field.
Aubrey qualified from the University of Dundee in 1987 (BDS) and has worked in hospital posts and as an associate and principal in general dental practice. He joined MDDUS in January 2006 and took on his role as head of dental division in 2009.
He said: “Our Scottish dental members receive a service that is second-to-none – our team of expert dento-legal advisers, backed by in-house and external lawyers, have more experience in managing claims and regulatory actions than anybody else in the Scottish dental protection market. Te threat of regulatory action can destroy careers and reputations but we have the experience and expertise to assist our members and we continue to engage with the GDC on behalf of our members.
“Our occurrence-based indemnity provides protection for incidents that occur while a person is in membership, regardless of when the claim is made. Tis means that protection is afforded to a member even after they have stopped paying their membership, for example when they have retired or indeed died, provided that they were in membership when the circumstances giving rise to the claim occurred.

“Discretionary indemnity allows us the flexibility to provide assistance and meet claims which an insurer may very well turn down. We do not exercise it to refuse a legitimate negligence claim awarded against a member. A commercial insurance premium gives you coverage only for claims made during the period of your contract – since claims arise on average two to three years after an incident, the first year’s premium only covers part of your risk.”
One such example MDDUS encountered, involved a claim of damages by a patient for the placing of a crown on a front tooth performed more than 25 years previously. Te dentist involved in the claim had since retired, but received the same access to professional assistance, dento-legal advice and indemnity as someone still working and in active membership now.
“MDDUS is a not-for-profit mutual membership organisation,” said Aubrey.
“Unlike insurers, we’re not in it for the profit. Insurers have to build in profit for shareholders, insurance premium tax and brokers’ fees – all costs that MDDUS quite simply doesn’t face. So it’s not surprising that you may expect an insurance policy to cost you more than MDDUS membership over the long term, not least because it is likely that you will have to purchase run-off cover if you stop paying your premium.
“Choosing indemnity over insurance means that dentists are protected so they can meet their patients’ expectations and needs as well as looking after themselves. MDDUS gives that confidence.”
