element of divorce that can be contentious is sorting out the practical issues, such as where each person will live, what money, property and pensions will be reallocated to whom, and arrangements for any children. At Sharp Family Law we aim to settle these issues out of court if at all possible and offer a range of process options such as collaborative law, constructive negotiation and mediation to enable you and your partner to reach a fair outcome by agreement rather than through the courts.

How much will it cost? Can you have a civilised divorce?

It is a huge challenge because it’s such an emotional issue but it can be achieved and most of my clients manage it. You need to focus on what you reasonably need, not what you think you should get to compensate for your spouse’s behaviour, be prepared to negotiate and compromise, put the children first and think of what’s in their best interests and aim to establish a reasonable relationship for the future. If you both agree on how to proceed with the divorce, the court will charge fees of £385 and most solicitors will charge under £1000 plus VAT for handling the process for you. However, the true cost of a divorce comes from dealing with the practicalities, such as splitting the family assets, and legal fees can easily escalate out of control if couples cannot agree and the issue goes before the court. It is far cheaper, and quicker, to use an alternative dispute resolution option and you will still be talking to your ex at the end of it!
