Some personal data, such as racial or ethnic origin, physical or mental health, religious beliefs or any criminal conviction, is defined as “sensitive personal data” and is therefore subject to greater protection under the Act.

Access to Personal Information

Under the Data Protection Act [DPA] 1998 you have a right to a copy of your personal information [data] held by the University [known as a data subject request]. You are able to access some of your personal data such as name, address, emergency contact via the student portal on the Blackboard system. For all other personal data you will have to make a written request, to the University’s Data Protection Officer and the University reserves the right to charge an administrative fee of £10. Prior to this data requests for personal data will be a subject access request. You have a right to ask the University to amend your personal information if it is inaccurate, or to object to it being processed if you believe that it is causing you damage and/or distress.

Further information about data protection can be found at: www.ljmu.ac.uk/secretariat/68133.htm or from the University’s Data Protection Officer at: secretariat@ljmu.ac.uk

Release of information to Third Parties

LJMU takes all of its responsibilities very seriously, including the obligations placed upon it by the Data Protection Act 1998. The key and contractual relationship is between the University and you, the student.

LJMU cannot release any information to parents or other sponsors, without your consent. (Please note, the DPA allows disclosure without consent in certain specific circumstances.) Where parents or sponsors pay tuition fees, this does not give them a right of access to your personal information. All necessary information will be issued to you, the student directly. It is then your responsibility to pass relevant information onto your parents or sponsors.

Also, LJMU cannot reveal personal information about students to other students.

Within the terms of the DPA and its DPA Notification, the University (via Faculty/School Offices, Student Zones, etc) discloses student information to a variety of recipients including: • Employees and agents of the University (on a strictly need-to-know basis only)

• Students’ sponsors (including local authorities, the Student Loan Company and funding councils)

• Relevant government departments and other public bodies to which we have a statutory obligation to release information, including the Higher Education Statistics Agency and the Quality Assurance Agency.

LJMU will release information to other bodies if they have a statutory right of access, if the University has a data sharing agreement with them, or if those bodies can successfully demonstrate that they require the information for certain specified purposes, such as:

• the detection and prevention of crime • the apprehension or prosecution of offender • or the assessment or collection of any tax or duty or any imposition of a similar nature.
