Clarifying the law on Speeding Offences


As a rider, lawyer and avid MAG member, I read with interest the letters and discussion on speeding in Issue 32.


The fact is, a speed limit is just that, the maximum speed permitted. Whilst there are discussions about ‘re-education’ of those caught speeding and in relation to allowances, the law remains as written. Therefore, just 1% over the limit could, in theory, lead to a prosecution!


There are alternatives to prosecution, such as the National Driver Improvement Scheme or the Speed Awareness schemes (run by companies/ local authorities in conjunction with Police Authorities). Much depends on the locality of the offence and the view of the local police, but we should also remember why there is a speed limit in the first place.


As discussed in Issue 32, a 10% ‘allowance’ refers to the speedo, you can operate a vehicle with a speedo up to 10% out (but more/less could lead to another offence). But as to whether 10% is allowed depends on discretion as to whether you are charged.


Penalty points and fines are commonly used as punishment and most points are fixed. Some offences carry a range which allows the court to assess the seriousness of the ‘bad riding’.


The minimum number of points is 3; 12 points in a 3 year period renders you liable to disqualification. Disqualification for penalty points carries a minimum 6 month ban, increased to 12 months is you’ve been disqualified for 56 days or more in the last 3 years.


‘Exceptional hardship’ can be put to the court (please note, the loss of your employment is not always taken into account), but they have discretion as to whether to disqualify or reduce the length of the ban. New riders, if you attain 6 or more points within 2 years of passing your first test, your licence is revoked with no appeal on revocation, only the original conviction.
