• Seven states tried and failed to pass legalized sports betting legislation. Surprises include more liberal states like Minnesota, California and Hawaii. Tribal gaming has been challenged since 2018 because
of its inherent sovereignty issues. Typically, tribes confront disadvantages not shared by commercial gaming interests. For many, permitting and establishing sports
betting on their land requires amending state compacts and possibly mandating federal governmental approvals from the U.S. Secretary of the Interior. It could take years to resolve any bureaucratic issues. Also, the Indian Gaming Regulatory Act’s (IGRA)
language may prevent tribes from accepting online bets while other commercial in-state operators have free access to players. There is good recent news for one tribe. The District of
Columbia (DC) Circuit Court handed a unanimous victory to the Seminole Tribe in Florida last June 30. Following an 18-month court battle with casino operators West Flagler Associates and the Bonita-Fort Myers Corporation on Florida’s Gulf Coast, the Seminole Tribe may now operate mobile sports betting within state borders. The 23-page decision reversed the federal district
court’s 2021 ruling that the compact between the Seminoles and the State of Florida gave the Seminoles a monopoly that violated IGRA. Although West Flagler could litigate the case up to the Supreme Court, for now, online sports betting could return to Florida by late 2023 via the Hard Rock Sportsbook app on most devices. It has taken only five years to realize that the combined online and land-based sports betting is a winner. Revenues totalled $2.3 billion in Q2 2023, which was an industry record for any second quarter since its legalization and a 56.6 percent year-over-year increase over 2022. As Major League Baseball (MLB) winds its season
down, the playoffs/World Series contests are scheduled for September into October. That, plus kick-off of the National Football League’s (NFL) season in September, should be an amazing time for American sports betting to hit records for the second half of 2023. Tens of millions will pull out their team jerseys to wear
over the next five months. Philadelphia Eagles fans like me will happily wear theirs on game days as they sing, “Fly Eagles fly on the road to victory.”
