Continúa votación de proyecto para regular apuestas online
La Comisión de Economía de la Cámara de Diputados avanza en la votación particular del proyecto para perfeccionar la regulación del mercado de apuestas en línea. La propuesta pretende generar un mercado competitivo de apuestas en línea; resguardar la fe pública; proteger la salud y la seguridad de los jugadores; aumentar la recaudación fi scal; y transparentar los orígenes y el destino de los recursos obtenidos a través de estas plataformas. La comisión, específi camente, se ahondó en los requisitos y procedimientos para obtener una licencia general de operación de plataformas de apuestas en línea. detallando que podrán optar por una licencia general de operación de plataformas de apuestas en línea, las sociedades anónimas cerradas constituidas en Chile, que se sujeten a las normas de control que rigen a las sociedades anónimas abiertas, según lo dispuesto en la Ley 18.046. En ese plano, tales sociedades también deben cumplir ciertos requisitos. Por ejemplo, se pide que el objeto social sea la operación y explotación de una plataforma de apuestas en línea y servicios anexos en los términos previstos en la ley y sus reglamentos. Asimismo, se establece que las sociedades solo podrán constituirse y funcionar con un máximo de diez accionistas registrando como capital social una cifra no inferior a 2.000 UTM (Unidad Tributaria Mensual*, o unos US$150 mil, en dinero o en bienes avaluables en dinero, bajo condiciones específi cas. Al respecto de las licencias, el Ejecutivo ya había señalado que las mejoras que se hacen son para reforzar y subir los estándares de los requisitos que se requieren para la operación de plataformas. Algo similar a lo que ocurre con los casinos, pero con algunas diferencias, estableciéndose en ese ámbito, que quienes pretendan desarrollar plataformas de apuestas en línea deberán solicitar a la Superintendencia de Casinos de Juego una licencia general de operación para su explotación.

Rep Commission advances on online gambling regulatory bill
The Economy Commission of the Chamber of Representatives continues advances in voting for the project to regulate the online betting market. The proposal aims to generate an online betting competitive market; safeguard public credibility; protect the health and safety of players; increase tax collection; and make transparent the origins and destination of the fi nancial resources related to online and sports betting platforms. The commission, specifi cally, delved into the requirements and procedures for obtaining a general licence to operate online betting platforms, detailing that operators from closed corporations incorporated in Chile, which are subject to the control rules governing open corporations, as provided in Law 18,046, may opt for a general licence for the operation of online betting platforms. At that level, such companies must also meet certain requirements. For example, it is requested that companies state that its corporate purpose is the operation and exploitation of online betting platforms and ancillary services in the terms provided for
in the law and its regulations. Likewise, it is established that companies may only be incorporated and operate with a maximum of ten shareholders registering as share capital a fi gure of not less than 2,000 UTM (Monthly Tax Unit), about US$150,000, in money or in assets valued in money, under specifi c conditions.
On the issue of the licences, the Chile Executive had already indicated that the improvements that are made in the online gambling legislation should be to reinforce and raise the standards of the requirements needed for the operation of online platforms. Something similar to what happens with casinos, albeit with some differences in that area, stating that those who intend to develop online betting platforms must apply to the Casino regulator for a general operating licence to enable them to operate.
