Lula amplía mecanismos de asfixia financiera al mercado ilegal de Bets


El Gobierno de Brasil ha endurecido los procedimientos para aplicar medidas de asfixia financiera al mercado ilegal de apuestas de cuota fija - llamadas “Bets ilegales”. El decreto número 13.033, firmado el pasado viernes 19 de junio por el presidente Luís Inácio Lula da Silva, refuerza los instrumentos para interrumpir flujos financieros, bloquear cantidades obtenidas de forma irregular y desmantelar el rendimiento económico de agentes que operan Bets fuera de la regulación. Los mecanismos que se están creando son similares a los ya utilizados en la asfixia financiera del crimen organizado y ha sido posible gracias a la aprobación, por parte del Congreso Nacional, de la Ley Antifacciones, propuesta inicialmente por el Gobierno de Brasil. Entre ellas está la “pérdida de activos” de las empresas que operan las llamadas “Bets ilegales”. Estas cantidades serán utilizadas por el Gobierno de Brasil para financiar el Fondo Nacional de Seguridad Pública, contribuyendo a la lucha contra las apuestas ilegales y otros tipos de delitos.


“La medida fortalece decisivamente la


capacidad del Estado brasileño para enfrentarse a los operadores ilegales. Quienes actúan fuera de la ley no pueden seguir utilizando el sistema financiero brasileño para sostener negocios clandestinos. Al bloquear la circulación de fondos en operaciones de apuestas no autorizadas, la norma llega al centro económico de las actividades ilícitas, reduce los incentivos para la ilegalidad y refuerza el compromiso del gobierno con una regulación seria y eficaz guiada por el interés público”, afirma el Ministro de Finanzas, Dario Durigan.


CÓMO FUNCIONA EL PROCESO Como autoridad reguladora y supervisora de la modalidad de apuestas deportivas, la Secretaría de Premios y Apuestas (SPA) del Ministerio de Hacienda, al identificar a un operador no autorizado, formalizará la irregularidad mediante una constatación oficial, que registra y fundamenta que es una explotación ilegal. Una vez emitida la constatación, la SPA notifica a las entidades financieras y de pagos para que bloqueen, en un plazo de 24 horas, todas las cantidades existentes e impidan nuevas transacciones relacionadas con la apuesta irregular. Las instituciones deben informar sobre el cumplimiento de las medidas tomadas en un plazo de 48 horas. Simultáneamente, se debe notificar al Banco Central la supervisión de la ejecución. La resolución del Consejo Nacional de la Moneta (CMN) regulará los procedimientos operativos para el bloqueo de cuentas y importes.


La iniciación y conducción de los procedimientos administrativos será responsabilidad de la Secretaría Nacional de Seguridad Pública (Senasp), del Ministerio de Justicia y Seguridad Pública, que notificará a la parte implicada presentarle su impugnación. Durante el proceso, pueden realizarse diligencias y solicitudes de documentos e información a instituciones financieras y entidades públicas. También corresponderá a Senasp adoptar las medidas necesarias para la instrucción del proceso, incluyendo la presentación de pruebas esclareciendo los hechos, observados o contradictorios a la defensa de esta.


“La medida llega en un buen momento. El decreto permite que las cantidades vinculadas a apuestas ilegales se reviertan a acciones que forman parte de la lucha de Brasil Contra el Crimen Organizado”, señala Wellington Lima, ministro de Justicia y Seguridad Pública.

Government extends financial asphyxiation mechanisms to illegal Bets market


The Brazilian government has tightened procedures to apply financial asphyxiation measures to the illegal fixed-odds betting market - called sporting “Bets”. Decree number 13,033, signed last Friday, June 19, by President Luís Inácio Lula da Silva, reinforces instruments to interrupt financial flow, block amounts obtained irregularly and dismantle the economic structure of agents who operate Bets outside local regulations. New mechanisms are being created similar to those already used in the financial asphyxiation of organized crime and have been made possible thanks to approval by the National Congress of an Anti-Faction Law, initially proposed by the Government of Brazil. Among measures is the “loss of assets” of companies that operate Bets illegally. Amounts confiscated will be used by the Government to finance the National Public Security Fund, which contributes to the fight against illegal gambling and other types of crimes. “This new measure decisively strengthens the capacity of the


Brazilian State to confront illegal Bets operators. Those who act outside the law cannot continue to use the Brazilian financial system to sustain illegal businesses. By blocking circulation of funds in unauthorized betting operations, the measure reaches the economic center of those illicit activities, reduces illegality incentives and reinforces the government’s commitment to serious and effective regulation which is guided by the public interest,” said Finance Minister Dario Durigan.


HOW THE PROCESS WORKS


As the regulatory and supervisory authority of the sports betting modality, the Secretariat of Prizes and Betting (SPA) at the Ministry of Finance, upon identifying an unauthorized operator will formalize the irregularity through an official Notice, registering and substantiating the operator with illegal sports betting exploitation. Once the Notice has been issued, SPA informs all financial and payment institutions to block, within 24 hours, all existing amounts and prevent new transactions related to the irregular betting operator. Institutions must report compliance of measures taken within 48 hours. At the same time, Brazil Central Bank must be notified about supervision of Notice execution. The resolution of Monetary National Council (CMN) will regulate the operational procedures used for blocking all accounts and amounts. All administration procedures throughout will be the responsibility of the National Secretariat of Public Security (Senasp), at the Ministry of Justice and Public Security, which will notify the parties involved in the injunction. During the process, procedures and requests for documents and information from financial institutions and public entities may be carried out. It also will be Senasp’s responsibility to adopt the necessary measures for the investigation of the judicial process, including the presentation of evidence supporting facts, in favour or contradictory to the operator’s defence.


“The Government measure comes at a good time. The decree allows all amounts linked to illegal gambling to be reverted to actions that are part of Brazil’s fight against organized crime,” says Wellington Lima, Minister of Justice and Public Security.
