CAE del Senado aprueba la regulación de apuestas deportivas*
La regulación de las apuestas deportivas online fue aprobada el 22 de noviembre por la Comisión de Asuntos Económicos (CAE) del Senado brasileño y ahora pasa al Pleno con carácter de urgencia. El proyecto de ley (PL) 3.626/2023, que garantiza la tributación de las apuestas por Internet, tuvo como relator y promotor al senador Angelo Coronel. La propuesta, ya aprobada por la Cámara de Diputados, forma parte del paquete del gobierno del presidente Lula buscando poner un balance a cero de la meta fiscal en 2024. Si el Pleno del Senado modifica el texto, el proyecto volverá a los diputados para su examen. Previamente a la votación, el senador Angelo Coronel leyó el informe del CAE sobre el PL 3.636/23, y de acuerdo con el texto, la apuesta de probabilidades fijas incluye eventos virtuales de juegos en línea y eventos reales de temática deportiva como fútbol y voleibol. En esta modalidad, el apostador gana si acierta sobre cualquier condición durante el juego o el resultado final del partido.
De acuerdo con la propuesta, las apuestas se pueden realizar en medios físicos, a través de la compra de boletos impresos, o de manera virtual, a través del acceso a canales electrónicos. El acto de autorización especificará si el agente de explotación solo puede actuar en una o ambas modalidades. El proyecto también aborda el deporte de fantasía, una modalidad electrónica en la que las disputas de luego tienen lugar en un entorno virtual con base en la actuación de personas reales. Según el texto, este tipo de apuesta no está configurada como una modalidad de lotería y está exenta de autorización por parte del gobierno. Las empresas que exploran actividades de desarrollo o prestación de servicios relacionados con el deporte de fantasía están sujetas a una contribución social del 12% sobre las ganancias.
“El mercado de apuestas de cuotas fijas ha crecido rápidamente
e involucra varios deportes, especialmente el fútbol. Para que el mercado de las apuestas deportivas funcione correctamente, este debe estar regulado. El proyecto viene precisamente a llenar ese vacío en la legislación brasileña y colocar al país a la vanguardia de la regulación de esta nueva actividad económica, con reglas claras para su autorización y la identificación de oferentes, el volumen de apuestas, la inspección y varios otros aspectos relevantes, además de posibilitar la recaudación de impuestos”, reiteró el senador Coronel.
Distribución del dinero Una enmienda aceptada el día previo a la votación cambio la forma para la distribución de la recaudación de las apuestas deportivas en medios físicos o virtuales. Según el texto, el 88% se destina a los gastos de financiación y mantenimiento del agente

Senate Commission approves sports betting regulations
Brazil Senate’s Economic Affairs Committee (CAE) approved regulations for online sports betting, Wednesday 22 November and they now go to the Plenary as a matter of urgency. Bill (PL) 3.626/2023, which guarantees the taxation on online betting, was presented and promoted by Senator Angelo Coronel. The text deals with local lottery modality called “fixed odds betting” – sports betting - and was opposed by several senators, such as Eduardo Girão and Carlos Portinho. The proposed bill, which has already been approved by the House of Representatives, is part of a package by President Lula’s government seeking to bring the fiscal target to zero in 2024. If the Senate Plenary modifies the text, the bill will return to the Lower house for further consideration. Prior to the vote, Senator Coronel read CAE’s report on PL 3.636/23, and according to the text it includes virtual
online gaming events and real sports-themed events such as soccer and volleyball. In this modality the bettor wins if he or she correctly forecasts any in-match proposition or the final result of the match.
According to the proposal, bets can be placed in physical
media, through the purchase of printed tickets, or virtually, through access to electronic channels. The authorisation Act shall specify whether the operating agent may only act in one or both modalities.
The bill project also tackles fantasy sports, an electronic modality in which bets take place in a virtual environment based on the performance of real people. According to the text, this type of bet is not configured as a lottery modality and is exempt from authorization by the government. Companies that explore development activities or provision of services related to fantasy sports are subject to a social contribution of 12% tax on profits. “The Sports Betting market has grown rapidly and involves
several sports, especially football, and in order for this activity to function properly, it must be regulated. The bill project comes precisely to fill this gap in Brazilian legislation and place the country at the regulation forefront of this new economic activity, with clear rules for its authorization and the identification of bettors, volume of bets, inspection and several other relevant aspects, in addition to making it possible to collect taxes,” emphasized Senator Coronel.
Tax revenue distribution An amendment accepted the day before voting changed the form of the distribution of revenues collected from sports betting in physical or virtual media.
