omo reportamos líneas abajo, esperamos que el proyecto de ley de casinos tenga su votación en el pleno del Senado brasileño en agosto, sin embargo, de ser aprobado, el reporte de BNL Data, sobre una simulación básica, nos dice que, “Los casinos pagarían 44,5% de impuestos y las apuestas deportivas o bets, 38,5%, y esto sin el Impuesto Selectivo”, y se desconoce cuánto podrá recaudar el sector, debido a que aún no está regulado para las apuestas, y legalizado para los juegos de azar. En verdad aún hay mucho por verse sobre el futuro de casinos en Brasil, pero de una forma u otra, es preferible contar con una industria bien reglamentada por todas las mejoras que el sector del Gaming siempre trae a la economía de un país. Ya veremos lo que viene.
Por otro lado, en México, la jueza federal María Isabel Bernal ha resuelto que la reforma al Reglamento de la Ley Federal de Juegos y Sorteos (LFJS), decretada el 16 de noviembre de 2023 por el Presidente Andrés Manuel López Obrador, es inconstitucional, y de esta forma se alinea con el juez Gabriel Regis – ver informe en interiores – estableciendo que el Ejecutivo no podía prohibir las tragamonedas en los permisos que se otorguen para nuevos casinos, así como en la renovación de los actuales, pues la Suprema Corte de Justicia aclaró en 2016 que dichas máquinas califican como “sorteos de números o símbolos” que dependen del azar, y por tanto están permitidas por la LFJS, que el Congreso no ha reformado desde 1947.
No solo eso, sino que también ha determinado que se deben permitir los juegos de naipes y la ruleta, y como el juez Regis, considera que estos pueden ser considerados como “sorteos”. Ambos jueces concentran alrededor de 60 demandas de amparo promovidas a nivel nacional por las permisionarias de casinos y sus operadoras, y según se espera, todos los amparos contra la reforma van a ser concedidos. Parece ser cuestión de ¡Mexicanos al grito de guerra!
Nos estamos tomando un descansito en julio, pero imagino que algunos nos veremos las caras en el evento iGaming Central América, en San Juan, Costa Rica, los días 6-7 de agosto, y si no, ya será hasta los GAT de Bogotá y Santo Domingo, en septiembre. ¡Alla nos vemos!

s we are reporting below, we expect the Brazilian casino bill to be debated and voted on in August at the Senate plenary session, However, if approved, BNL Data’s report, based on a basic simulation, tells us that: “Casinos would carry 44.5% tax rates and sports betting 38.5%, and this without Selective Tax,” as it is unknown how the gaming sector will be taxed on this item because sports betting has yet to be regulated or casinos legalized. In truth there is still much to be debated and to decide on the future of casinos in Brazil but one way or another it is preferable to have a well-regulated industry for all the improvements that the Gaming sector always brings to a country’s economy. It’s a matter of wait and see over the next few months.

Over to Mexico, where Federal Judge María Isabel Bernal has ruled unconstitutional the reform to the 1947 Regulations of the Federal Law on Games and Sweepstakes (LFJS), decreed on November 16, 2023, by President Andrés Manuel López Obrador. In this way her judgement aligns with Judge Gabriel Regis – see report below – establishing that the Mexican Executive is not able to prohibit slot machines in permits granted for new casinos, as well as in the renovation of current numbers or symbols” whose outcome depend on chance, and therefore, allowed by LFJS, which Congress has not reformed since 1947.
Not only that, because Judge Bernal has also that card and roulette games should be permitted, along with Judge Regis, nationwide by casino permit holders and their operators, and it is expected that all injunctions against the Executive reform will follow suit. Mexicans, you may recall, have gone to war for much less!
We are taking a break on events in July, but I imagine that some of us see each other at the iGaming Central America event, in San Juan, Costa Rica, on August 6-7 or meet at GAT events in Bogotá and Santo Domingo, in September. See you there!
