BRASIL – Gobierno presenta el Primer borrador para regulación de apuestas deportivas

(SECAP), Alexandre Manoel Angelo da Silva, informó las líneas principales del primer borrador del proyecto de decreto que permitirá a operadores de apuestas deportivas internacionales hacer negocio en Brasil en este segmento. Existen expectativa de aumento de la recaudación de impuestos en las loterías del orden de unos US$5.000 millones (R$20.000 millones) con la entrada en funcionamiento de la Lotex y las apuestas deportivas de cuotas fijas, las que más que duplicarían el actual mercado interno de loterías. Es decir, con las dos modalidades mencionadas anteriormente, la relación entre la recaudación y el producto interior bruto debe pasar del nivel actual del 0,2% al 0,5% del PIB. La apuesta de cuota fija no significa necesariamente un gran aumento de los recursos destinados al gobierno: el objetivo es inhibir la ilegalidad, promover la integridad del deporte y mejorar el entorno empresarial. En el marco del evento Brasil Futebol Expo, organizado por la CBF la semana pasada, el ministro da Silva aseguró que las medidas que se presentarán oficialmente este mes en esta propuesta para el mercado, preparada con la experiencia y estudios del staff del Ministerio conjuntamente con recientes resultados de la consulta pública iniciada por la SECAP, la cual tuvo una inesperada alta participación con un monto de 1.849 sugerencias de parte de todos los sectores involucrados. En el proyecto se establecen las normas que se seguirán para
la exploración del sector, con normas que deben cumplir las empresas, el régimen fiscal y las sanciones a los infractores. El documento busca seguir las mejores prácticas y evitar errores cometidos en otros mercados:
Régimen de autorización La respuesta de la consulta pública sobre el tema fue firmemente favorable a la opción elegida. Esto significa que no habrá límites en el número de casas de apuestas que deseen operar en Brasil. El Ministerio busca dar más flexibilidad a todas las empresas que operan en el mercado y que cumplen con los demás requisitos del decreto.
Tarifa de autorización por única vez Para poder operar en el país, las empresas tendrán que pagar una única cuota de autorización de R$3 millones (US$735.000). Esta licencia tiene una validez de nueve años. Transcurrido ese plazo, los operadores deben renovar esta autorización con un

Lottery at the Ministry of Economy (SECAP), has announced the principal items of the first draft for the sports betting regulations decree that will allow operators to do business in Brazil. There are high expectations of increased tax
revenue from lotteries of around US$5 billion with the launch of the tender for the operation of Lotex and of fixed-odds sports betting, which would more than double the
current market lottery in Brazil. The two betting formats mentioned above are likely to increase tax revenue with the ratio of gross domestic product increased from the current level of 0.2% to 0.5% of GDP. Minister da Silva said that “fixed-odds betting does not
necessarily mean a large increase in government resources, as the aim is to inhibit illegality, promote the integrity of sport and improve the business environment.” At the Brazil Futebol Expo, organized by the local FA (the CBF), Minister da Silva made the assurance that the measures to be officially proposed later in the month for the sports betting market have been prepared with the experience and study of the ministry’s staff in conjunction with recent results of the public consultation initiated by SECAP, which had unexpectedly high participation of some 1,849 suggestions from all sectors involved. The Sports Betting draft sets out the rules to be followed for the development of this sector, with rules to be complied with by companies, tax regime, and penalties for offenders. The document seeks to follow best operating and compliance practices and avoid mistakes made in other markets, along the following lines:
Authorization regime The response of the public consultation on the subject was strongly in favour of the chosen option. This means that there will be no limit set on the number of bookmakers who wish to operate in Brazil. The Ministry seeks to give more flexibility to all companies operating in the market that meet all legal requirements.
One-time only Authorization fee In order to operate in the country, companies will have to pay a single authorization fee of R$3 million (US$735,000). This license is valid for nine years. After this period, operators must renew
