This is a copy of the letter which all companies will be receiving shortly. Please note, if you do not receive a letter you should still check whether you are required to register, and take action if you are.


Dear Sir/Madam,


We wrote to you previously to raise awareness of The Information Commissioner’s Office (ICO), the data protection fee and to highlight the advice and services we offer to small businesses.


Our records show that Company Name has not taken any action following our letter with the response date of 08 March 2021.


We did not follow this up with you earlier as we understand that Covid-19 has affected many businesses. You may not have been able to respond to our request, as we know this is a very challenging time.


While it is a legal responsibility to pay the data protection fee, there are some exemptions, so it is worth checking if you are exempt.


If you are holding or processing personal information electronically (including using CCTV for crime prevention reasons) and cannot rely upon an exemption, we asked you to go to https://ico.org.uk/fee to pay your data protection fee online – or to notify us if an exemption applies by filling in the short form at https://ico.org.uk/no-fee. Please do this by 03 September 2021.


There is no need to call us if you have registered, filled in the exemption form, or recently deregistered from Companies House, but we do have a helpline number in case you need it: 0303 123 1113 ext. 1700.

CONCLUSION


You may have seen comments and advice all over Facebook and WhatsApp groups nationwide on this topic, this is because this is not a topic to be taken lightly.


The risks of non-compliance with the relevant legislation is no laughing matter and not one which can be ignored or dismissed as “I have a sticker up so I am fine”, or “I paid

my registration fee so I am compliant” or even “my council says I can”; UKGDPR and DPA is regulated by the Information Commissioners Office and is a very serious matter!


So of course we fully endorse and actively encourage protection measures, we are fully behind the use of CCTV, but you must also take your responsibilities when capturing personal data of your customers very seriously!
