FEATURE Y ou need to check that:


• the documents are originals, genuine and refer to the applicant

Check that the documents are v alid


• the dates for the worker’s right to work in the UK hav e not ex pired


• photos are the same across all documents and look like the applicant


• dates of b irth are the same across all documents


• the person has permission to do the type of work you’re offering


When you copy the documents:


• make a copy that can’t b e changed, eg a photocopy


Copy and keep the documents for your records


• for passports, copy any page with the ex piry date, applicant’s personal details including nationality, date of b irth, name, photograph and signature, together with the current immigration endorsement ( such as a work v isa) copied on b oth sides


( including any limit on the numb er of hours they can work)


• all documents are current ( other than those issued to UK, E E A and


S wiss nationals and P ermanent Residence Cards issued to family memb ers of E E A nationals)


• if two documents giv e different names, supporting documents show why this is, for ex ample marriage or divorce


• for all other documents, make a complete copy


• keep copies during the worker’s employment and for two years after the person stops working for you


• ensure that you record the date you made the check


• for migrant students, keep a record of their term and v acation times


What will happen if I’m caught out?


H opefully, you hav e followed all the necessary steps to av oid this from happening, b ut if you are caught employing an illegal worker, you will receiv e a ‘ referral notice’ to let you know that your case is b eing considered, and that you may well


b e liab le to a civ il penalty of up to , for each illegal orker


I f you can prov e you conducted the required checks you will not face a penalty, unless you employed


someone who you knew did not hav e the right to ork f youre found liable for a penalty, you’ll b e sent a ‘ civ il penalty notice’ and hav e 2 8 days to respond his ill inform you of your payment options and what to do nex t, as well as how to ob j ect and appeal against the penalty if you ant to


I f you are conv icted of ‘ knowingly employing’ an illegal worker, you may


b e sentenced for up to two years’ imprisonment and/ or receiv e an unlimited ne lus, your business details may b e pub lished b y the H ome fce, causing unknon damage to


your reputation and the credib ility of your company


I t is possib le of course that a j ob applicant is unab le to show any documentation n this instance, it is best to use the ome fces


E mployer Checking S erv ice to see if an applicant has the right to work, if either they can’t show you their documents and you are reasonably satised that they have an outstanding appeal or application with the ome fce, or if they have either an A pplication Registration Card or a erticate of pplication
