Land at risk from new round of compulsory purchase orders


I


ncreasing demand for land from developers is threaten- ing landowners’ property as- sets – potentially leaving them out of pocket and with serious up- set to their business. A new round of national in- frastructure planning could see more land taken for development – perhaps under compulsory pur- chase – as the government con- tinues to invest across the UK, warns the Central Association of Agricultural Valuers (CAAV). There are lots of transport and energy infrastructure schemes already under way across the country. The government is also looking at water resources and considering what kind of national infrastructure they might need, explains CAAV policy and tech- nical adviser Kate Russell. “There could be more large wa- ter infrastructure projects com-


ing forward, such as reservoirs and transporter pipelines, as there has been talk for a long time about the need to store more wa- ter and move it around the coun- try more easily.”


Making it easier to move water

But while landowners could benefi t from these schemes, they may also fi nd themselves facing demands to supply land for such development. gime for gaining consent. Al- though developers should engage early with affected landown- ers, this doesn’t always happen, warns Ms Russell.


Minimum impact “I think developers under-esti- mate the time and cost of proper- ly consulting with affected land- owners and businesses,” she says. “But if they do it properly, every- one will benefi t from a better de- signed scheme, which should have the minimum impact on claimants.”


As a last resort, developers can be given powers to compul- sorily purchase land under these schemes. They can also sur- vey land before the start of the scheme – and a notice seeking en- try might be the fi rst point of con- tact with a landowner or farmer, explains Ms Russell.


Developers don’t always engage early with affected landowners, says Kate Russell.


“Affected farmers and land- owners should seek profession- al advice from a suitably quali- fi ed agricultural valuer as soon as they become aware of a scheme, as the impact of the project on the land and business could be very signifi cant.”
