The MLC was further bolstered in January 2017 with the additional requirement that financial security by an insurer or other financial security provider be displayed in a conspicuous place on board all MLC vessels in respect of: Outstanding wages and repatriation of Seafarers following abandonment together with incidental costs and expenses; compensation for death or long term disability.
The amendment bringing about this requirement describes ‘abandonment’ broadly as when an owner: fails to cover the cost of repatriation; or has left the Seafarers without necessary maintenance and support (including adequate food, drinking water, fuel for survival on board and necessary medical care); or has otherwise unilaterally severed their ties with the Seafarers including failure to pay contractual wages for at least two months.

THE PRODUCT Allianz Worldwide Care provides no-fault based health insurance to crewmembers and their dependants around the world for medical costs which are incurred both on and off the vessel.
Allianz Worldwide Care insurance, although purchased by the Member, is personal to staff and provides medical costs cover to them irrespective of an owner’s liability and without deductible. If a crewmember is unwell or has an accident whilst on shore leave they can seek medical help without any cost to themselves and will be fit for their contract when they join their vessel.

Yachts insuring their crew liabilities with a P&I Club can have this ‘financial security’ certification issued by many Clubs without additional cost. Indeed representatives from the IG have consulted with a number of flag states to ensure that the certification is acceptable, in the absence of a prescribed format.
The idea behind these financial security requirements is to have a visible safety net in place should an owner/manager fail to comply with their obligations. Whilst the owner would already be in breach of their MLC obligations, the additional measure of requiring financial security gives the provisions real force and so should give comfort to the crew.

MLC CONTRACT REQUIREMENTS – CAN YOU COMPLY?
As the fourth pillar of international maritime regulation and protection for Seafarers’ rights, the MLC sets out the standard required in a Seafarer’s employment agreement.
So what should owners and managers do to ensure that they are entering into a MLC compliant agreement?
As a starting point, the following details should be evident in each:
• Details of the crew • Owner or manager’s name and address • Place and date when agreement is entered into • Job role • Details of wages • Annual leave • Conditions for termination or date of expiry • Health and social security benefits • Repatriation entitlement
Furthermore, the MLC provides that the crew contract must be signed by the crew member AND the employer.
