Congress will now have 60 days to pass legislation that would stop the rule, but the catch is that it must be legislation President Obama will sign. (The clock began ticking the day the rule was released, May 27.)

Over the last two months, GHBA Government Affairs Committee members met with GHBA’s congressional delegation. In addition to discussing immigration reform and President Obama’s Executive Order on floodplain development, committee members reminded the congressional delegation of GHBA’s opposition to EPA’s proposed Waters of the U.S. rule.
Later, on May 12, the House of Representatives passed H.R. 1732, the Regulatory Integrity Protection Act of 2015 that directs the EPA and Corps of Engineers to withdraw the proposed rule within 30 days and develop a new rule.
This was a bi-partisan bill as it garnered support from 24 Democrats and 237 Republicans, including the following GHBA delegation members: Congressmen Babin, Brady, Culberson, Gene Green, McCaul, Olson, Poe and Weber. GHBA thanks them for their support!
The next step for H.R. 1732 is to be considered in the Senate.
On a parallel track, House members have included language prohibiting the EPA and Corps from funding the proposed rule in the Energy & Water Appropriations bill. At the end of last month, the Senate was in the process of considering its version of the Energy & Water Appropriations bill in committee. At that time, the House prohibitive language was not yet included in the Senate legislation.
However, the hope remains that the House and Senate can work together within the next 60 days and send legislation to the President that curtails the EPA and Corps’ authority in implementing this very devastating rule.
