It continues to amaze me to see how many people are involved in producing the Con-


vention – just like a Fair – it takes everyone working together to make it a success! So regardless of how small or how big a part you played in the convention – know that YOU are what made it a success! “Minimum Exhibits Waiver”


Section 616.17 of the Flor-


ida Statutes sets forth the minimum number of exhibits to be displayed by a fair as- sociation in order to receive its tax exemption certificate from the Florida Department of Agriculture and Consumer Services (“Department”). A lengthy list is set forth in sub-section (1) of the Section, which provides the type and number of field crops, culinary exhib- its, fruit or vegetable crops and livestock which shall be displayed, just to name a few. However, in the event a fair association cannot display the re- quired exhibits, there is a procedure in which to ob- tain a waiver from the Department.

sub-section (3) of the Statute, the Department may provide a waiver to the minimum exhibit require- ment to any fair association that submits an appli- cation for waiver to the Department at least 30 days prior to the fair (the time period was reduced from 60 to 30 days in the legislative statutory re- write of Chapter 616 in 2012). The application for a waiver must show good cause why the require- ments cannot be met. It is very important that if a fair association cannot meet the minimum exhibits requirement, that you timely submit an application for waiver on behalf of your fair.
