BABA successfully launches 2012 campaign, informs builders of legal risks


A


n overflow crowd attended BABA’s February lunch meeting in Friendswood. The guest speaker was Ian Faria from Coats | Rose law firm. Ian informed the room full of builders, remodelers, contractors and suppliers about a wide variety of legal topics such as RECLA, OSHA, waivers, liens and general liability insurance. Here are a few specifics from Ian’s presentation:


„ How Chapter 27 of the Texas Property Code (RECLA) really protects contractors.


„ Review of deadlines associated with RECLA.


„ OSHA’s mission has changed from worker safety to revenue generation, see website.


„ Contractors better have a safety plan in place. „ The residential roofing exemption no longer exists. „ Lien laws have changed in regards to the collection of retainage. „ Protections against fraudulent liens are now in effect. „ Some waivers being used offer no protection against law suits.
