FACTS: On August 19, 2001, from ap- proximately 10:30a.m. until approximately 3:15p.m., Nathan Goodman was lawfully sitting in the pas- senger seat of his disabled vehicle, parked on a gravel area off the right shoulder of River Road, near Maidens Bower Drive in Montgomery County.␣ A police officer had directed him to the area in which he

was parked.␣ Nathan Goodman was a member of and had requested emergency road assistance from American Automo- bile Association (hereinafter “AAA”), pursuant to the Emergency Road Service program at approximately 10:30a.m.␣ Nathan Goodman understood and read AAA Members Benefits as “AAA commit- ted to the safety of you and your family,” “Emergency Road Service assists you in an emergency when your vehicle cannot be driven,” and “The Club makes every attempt to provide prompt, reliable and efficient service.”␣ He was told a tow truck would arrive within 60-75 minutes.␣ He was speaking on his cell phone to AAA for the sixth time at approximately 3:15p.m., again requesting a tow truck,


after being assured during each call that a tow truck was being sent to him.␣ At ap- proximately 3:15p.m., Elizabeth Voss was operating a vehicle in the same area on River Road.␣ She veered off the roadway and to the right of the shoulder and crashed into Nathan Goodman’s vehicle. The vehicles were totaled and towed from the scene by police towtrucks.


ALLEGATIONS OF LIABILITY: • Goodman claimed Elizabeth Voss was negligent in the operation of her mo- tor vehicle.
