FACTS: In 1999, Ms. Blackowicz underwent an D&C and hysteroscopy which was per- formed by Dr. Williamson. During the procdeure, Dr. Williamson punctured her uterus. He then biopsied a piece of her small intestine mistakenly believing that it was an endometrial poly.
Allegations:
The allegations of negligence included Dr. Williamson’s failure to realize that he punctured the uterus and his failure to appreciate that he was not seeing a polyp through his hysteroscope but was actu- ally seeing small intestine
Injuries_Damages: Ms. Blackowicz spent 15 days in the hos- pital. Her bowel had to be repaired. She sustained peritonitis, organ failure, sep- sis, and spent several days in the intensive care unit. She ultimately recovered with no permanent injuries

Decedent operated on for valve replace- ment and developed tampinade causing stroke. As a result of stroke, decedent was brain dead. Remained in vegetative state for some time and died of complications.
Allegations of Liability That surgery should have been delayed to rule out that decedent did not have pneumonia. In addition, tampinade should have been discovered sooner and addressed
