the continued weakness of his left leg. At that time, other than the weakness of his left leg and pain when he attempted to walk, he had no other complaints. The doctor who saw him alleged that the only complaints that were related to him were low back pain and bilateral weakness of his thighs and that after giving these com-


plaints, the decedent and his wife refused to let the doctor examine them because they were mad for having to wait an ex- cessive amount of time and not being able to see their regular doctor. Two days later, the decedent died of a ruptured aortic dissection.


Allegations of Liability:


The ER failed to perform adequate tests, failed to properly interpret tests, failed to


properly diagnose, failed to hospitalize the decedent and initiate proper treatment. The personal physicians group at GW that regularly treated the decedent was guilty of the same since they were consulted while he was in the hospital ER and fur- ther failed to properly examine him when he presented for treatment on his regu- larly scheduled appointment date.

Case Outcome


Case was settled with ER prior to trial for $ 499,900 and tried against GW only. Verdict returned after a week and a half of $ 713,500.


Special Remarks


Decedent was suffering from chronic re- nal failure sometime prior to the incident, and it was estimated would have been on dialysis within one to three months of the incident. His life span after that was esti- mated at anywhere from six months to a year and a half. He was retired at the time of the incident and left a wife and two adult children who were both employed.
